STATE OF NORTH CAROLINA TAX DISTRICT FIRE <br />SERVICE CONTRACT <br />COUNTY OF CABARRUS <br />THIS TAX DISTRICT FIRE SERVICE CONTRACT ( "Contract ") is made <br />and entered into effective the 1St day of July, 2013 by and between FLOWES STORE <br />VOLUNTEER FIRE DEPARTMENT ( "Department ") a North Carolina nonprofit <br />corporation and CABARRUS COUNTY ( "County "), a body politic and political <br />subdivision of the State of North Carolina. <br />PURPOSE <br />The purpose of this Contract is for the Department to provide fire protection and <br />other life services to the residents within its Rural Fire Protection Tax District and for the <br />County to fund these services with the tax collected within that District for that purpose, <br />pursuant to the provisions of N. C. Gen. Stat. §69-25.5. 69 -25.6 and 153A -233 <br />TERMS <br />1. The County agrees to levy and collect upon all taxable property lying <br />within the County boundaries of the Department's Rural Fire Protection Tax District <br />( "District ") an ad valorem property tax equal to .046 cents per one hundred dollar <br />assessed valuation, and after deduction of the Count's administrative charge (1' /z %) for <br />collection of such taxes, to pay the same to the Department. All monies collected will be <br />paid to the Department regardless of actual dollars budgeted, but unless otherwise <br />specifically agreed, payment of such tax proceeds to Department shall be County's sole <br />financial responsibility to the Department. <br />2. The County Tax Administrator shall collect the ad valorem taxes so levied <br />and shall make payments of the same to the Department monthly as collections are made. <br />3. The Department agrees to furnish and provide continuing fire protection <br />and other life safety services to all residents and property within the boundaries of <br />District by dispatching upon call any or all of its equipment and adequate personnel to <br />operate same. The Department shall furnish all those services in a professional and <br />efficient manner so as to meet the requirements of and comply with rules and regulations <br />of the North Carolina Office of the State Fire Marshal and all other applicable federal, <br />state and county laws, regulations and standards. The Department also agrees to operate <br />within the rules, regulations and guidelines as set forth in Article II of Chapter 34, Fire <br />Prevention and Protection, of the Cabarrus County Code of Ordinances, which is <br />incorporated by reference into this Contract. <br />4. The Department shall participate, within the limits of its personnel and <br />equipment resources and capabilities and with deference to its primary responsibility, in <br />Attachment number 1 <br />G -5 Page 168 <br />
