STATE OF NORTH CAROLINA TAX DISTRICT FIRE SERVICE CONTRACT COUNTY OF CABARRUS THIS TAX DISTRICT FIRE SERVICE CONTRACT ( "Contract ") is made and entered into effective the 1St day of July, 2013 by and between FLOWES STORE VOLUNTEER FIRE DEPARTMENT ( "Department ") a North Carolina nonprofit corporation and CABARRUS COUNTY ( "County "), a body politic and political subdivision of the State of North Carolina. PURPOSE The purpose of this Contract is for the Department to provide fire protection and other life services to the residents within its Rural Fire Protection Tax District and for the County to fund these services with the tax collected within that District for that purpose, pursuant to the provisions of N. C. Gen. Stat. §69-25.5. 69 -25.6 and 153A -233 TERMS 1. The County agrees to levy and collect upon all taxable property lying within the County boundaries of the Department's Rural Fire Protection Tax District ( "District ") an ad valorem property tax equal to .046 cents per one hundred dollar assessed valuation, and after deduction of the Count's administrative charge (1' /z %) for collection of such taxes, to pay the same to the Department. All monies collected will be paid to the Department regardless of actual dollars budgeted, but unless otherwise specifically agreed, payment of such tax proceeds to Department shall be County's sole financial responsibility to the Department. 2. The County Tax Administrator shall collect the ad valorem taxes so levied and shall make payments of the same to the Department monthly as collections are made. 3. The Department agrees to furnish and provide continuing fire protection and other life safety services to all residents and property within the boundaries of District by dispatching upon call any or all of its equipment and adequate personnel to operate same. The Department shall furnish all those services in a professional and efficient manner so as to meet the requirements of and comply with rules and regulations of the North Carolina Office of the State Fire Marshal and all other applicable federal, state and county laws, regulations and standards. The Department also agrees to operate within the rules, regulations and guidelines as set forth in Article II of Chapter 34, Fire Prevention and Protection, of the Cabarrus County Code of Ordinances, which is incorporated by reference into this Contract. 4. The Department shall participate, within the limits of its personnel and equipment resources and capabilities and with deference to its primary responsibility, in Attachment number 1 G -5 Page 168
