Attorney's Certification of Site Control (For Development Projects Only) <br />Applicant: Cabarrus County Project's Title: Rob Wallace Park <br />1. SITE CONTROL: Indicate the type of control the applicant has over the project site. Please provide a <br />separate form for each deed, lease, or easement within the project site. Include a copy of each deed, lease or <br />easement for each parcel included in the project site. Also provide one map that shows the park boundary and <br />identifies the location of all parcels, leases or easements within the pr2ject site. Please label all documents. <br />TYPE OF CONTROL PORTION OF SITE DOCUMENTATION ATTACHED* <br />® Entire Site. <br />® Fee Simple Title ® Copy of deed <br />❑ For that portion labeled on the site map: <br />Parcel Identification <br />(such as Parcel A, Parcel B, etc.) <br />❑ Entire Site. <br />❑ Signed copy of the current lease <br />❑ Lease <br />with a written description of the <br />❑ For that portion labeled on the site map: <br />applicant's authority to provide <br />Parcel Identification <br />public recreation for at least 25 <br />such as Lease A, Lease B, etc. <br />years. <br />❑ Entire Site <br />❑ Signed copy of the current <br />r_1 Easement <br />easement with a written description <br />❑ For that portion labeled on the site map: <br />of the applicant's authority to <br />Parcel Identification <br />provide public recreation for at least <br />(such as Easement A, Easement B, etc.) <br />25 years. <br />2. LIMITATIONS, CONDITIONS OR ENCUMBRANCES; <br />a) For property owned or to be owned by the applicant, describe all easements or encumbrances. <br />b) For property to be controlled through other methods, describe any conditions or limitations in current or <br />proposed leases, easements or use agreements, including restrictions on the applicant's use of the site or the <br />rights to be reserved by the landowner, that may in any way impact the applicant's ability to complete the project <br />in a timely manner and provide for public recreational use for at least 25 years: <br />❑ No limitations, conditions or encumbrances (See schedule B of attached Title Insurance Policy) <br />3. CERTIFICATION: (This form must be signed by the applicant's attorney or chief administrative <br />officer capable of certifying that the information provided is accurate). <br />I hereby certify that the information provided above and attached is accurate to the best of my knowledge.
