Exhibit F <br />Turner <br />CABARRUS COUNTY SHERIFF'S DEPARTMENT <br />AMENDMENT # 5 TO THE GMP — 6 T & 7TH FLOOR ALTERATIONS <br />CLARIFICATIONS & ASSUMPTIONS <br />GENERAL <br />Allowances: <br />An allowance of $ 50,000 is included for an Owner Contingency. This allowance is <br />separate from the 4% Contractor's Contingency. <br />Alternates: <br />• Owner Preferred Vendor Alternates 1 — 17 (Published in Addendum #2) All are <br />included in the total cost of Amendment #5 to the GMP. <br />Clarifications & Assumptions: <br />1) These Clarifications & Assumptions take precedence over the contract agreement <br />and contract documents and work in conjunction with the Clarifications & <br />Assumptions as established with Amendment # 1. <br />2) Amendment No. 5 incorporates the 6th and 7th Floor Alterations into the Scope of <br />the Work of the Contract dated October 21, 2008. The terms and conditions of the <br />Contract apply to the 6th and 7th Floor Alterations; provided, however, the 6th and <br />7th Floor Alterations are a distinct and separate phase of the Work of the <br />Contract. Contract provisions pertaining to the time for completion, acceptance of <br />the Work, occupancy, the cost of the Work, insurances, the time for making <br />payments, guaranties, warranties, the time for bringing actions to enforce the <br />provisions of the Contract and any other provisions sensitive to or dependent on <br />the date of Substantial Completion or the date of Final Completion will be applied <br />individually to the separate phases of the Work as if the separate phases of the <br />Work were under separate contracts. The performance of one phase of the Work <br />will be evaluated without regard to the performance of another phase. This <br />Amendment to the GMP was based on the project construction schedule included <br />within this report. <br />3) Turner Construction will endeavor to meet the overall Contract cap amount of <br />15.52% for fee & general conditions per Article 9 — Section C of the Contract. <br />4) This proposal is valid for 30 days. <br />5) The Contractor's Contingency is for Turner's use and is intended to cover cost <br />exposures resulting from unanticipated coordination problems or contractor budget <br />overruns within the GMP. It is not intended to cover additional costs resulting from <br />increases in project scope or program, the substitution of more costly materials, or <br />the overruns in allowances. The Contractor's Contingency is not intended to cover <br />so- called 'force - majeure' events or unknown conditions.
