Memo <br />To: Cabarrus County Board of Commissioners <br />From: Susie Morris, AICP, CZO, Planning and Zoning Manager <br />CC: File <br />Date: 6/20/2012 <br />Re: Proposed Text Amendments to Cabarrus County Zoning Ordinance (TEXT2012- 00001) <br />On May 8, 2012, the Cabarrus County Planning and Zoning Commission voted unanimously (9 -0) to forward Text <br />Amendment 2012 -00001 to the Board of Commissioners for final consideration. Attached you will find proposed text <br />changes to the following Chapters of the Cabarrus County Zoning Ordinance: <br />Chapter 2, Definitions- This Chapter provides definitions and terms used in the Zoning Ordinance. Several definitions <br />need updating due to changes in the North Carolina General Statutes. Several uses and common terms used in the <br />zoning ordinance were also not defined. <br />Chapter 3, Establishment of Zoning Districts- This Chapter provides descriptions of the zoning districts and the uses <br />permitted in each district. Permitted use lists have been updated with temporary uses as well as additional uses added <br />to the Table of Permitted Uses in Chapter 3. <br />Chapter 3, Table of Permitted Uses -This table lists all of the permitted uses and classifies them as permitted (P), <br />permitted based on standards (PBS) or conditional (C). The "new" Table of Permitted Uses will be housed in Chapter <br />3, Section 3 -8. This table combines tables from Chapter 3, Chapter 7 and Chapter 8, into a single resource for users to <br />reference when determining permitted uses in a particular zoning district. <br />Chapter 7, Performance Based Standards- This Chapter lists uses designated as "PBS' in the permitted use table and <br />the specific standards for the proposed use. These types of uses receive final approval from Staff. <br />Chapter 8, Conditional Uses- This Chapter lists uses designated as a "C" in the permitted use table and the specific <br />standards for the proposed use. These uses receive final approval from the Planning and Zoning Commission, acting <br />as Board of Adjustment. Additional language was added at the beginning of the Chapter to describe the process for <br />obtaining a Conditional Use Permit from the Board of Adjustment. <br />Appendix C, Trail and Trail Head Design- This appendix provides trail design concepts and minimum standards for <br />trails, blueways and trail heads. <br />• Chapters 2, 3, 7, and 8, will be removed from the ordinance and replaced with the new chapter. <br />• Appendix C -Trail and Trail Head Design is a new Appendix that will be added to the zoning ordinance. <br />• Red text represents additions, corrections or new text. Strikethrough text represents text to be deleted. <br />• The Board of Commissioners will need to hold a public hearing and consider adopting the proposed text <br />changes. <br />Attachment number 1 <br />G -1 Page 126 <br />
