Cabarrus County Zoning Ordinance <br />Chapter 3- Establishment of Zoning Districts <br />be processed as a speeffial conditional use district in accordance with Section 13 -12 of this <br />Ordinance with the following additions: <br />The following criteria shall apply to all proposed PUD developments: <br />a. Eligibility. An application for PUD must be submitted by the property owner or <br />property owner's representative <br />b `e° aig of iget less —tom The proposed area for the PUD must be 25 acres or <br />more. <br />c. ma y. Critical areas and other significant and desirable <br />natural features such as steep slopes, drainage courses, unique stands of vegetation, <br />riparian areas and water bodies are to be retained and integrated into the site <br />design. <br />e GeRg eg "°eh'teetHFa' :FheHg, All buildings and structures in the project site area <br />are to share a common architectural theme that ensures compatibility among interior <br />land uses. This theme shall also be compatible or complementary with adjacent <br />development, or shall be adequately screened or buffered from such adjacent <br />development. <br />f. Adlemignigg I=aigd Use Geig9patibility. The project site design shall be laid out in a <br />manner that ensures compatibility and harmony with adjoining land uses. e_�, to <br />g. C ST All public and private streets within the project site area shall comply with <br />North Carolina Department of Transportation (NCDOT) design guidelines. <br />h. Hangmigg Geigveigtieig. Upon approval, the zoning district will be known by the name <br />Planned Unit Development and will be designated as "PUD" on the zoning maps. <br />The Cabarrus County Planning and Zoning BeaFd Commission hear considers the "PUD" <br />request and the preliminary site plan approval request concurrently., exEept that— The final <br />decision to approve or deny each request, however, shall be by a separate vote. The <br />Cabarrus County Planning and Zoning mo d• Commission shall first make a decision whether <br />to grant approval for the requested "PUD" district. If the "PUD" request is denied, the <br />Cabarrus County Planning and Zoning d Commissio, will no longer consider the request <br />for approval of the preliminary site plan. If the "PUD" district is approved, the Cabarrus <br />County Planning and Zoning Beard Commission shall then make a decision whether to <br />approve the preliminary site plan. <br />Applications for PUD are a4-s eligible for the expedited rezoning process as prescribed in <br />Chapter 13. SeEt n 1:3 12, tep <br />= r <br />Permitted Uses <br />The uses permitted in a PUD district shall be the permitted uses as set forth in the approved <br />site plan. Because the PUD is a floating district, these uses will be selected from those uses <br />peFfflitted listed in GhapteF 3 Seetien 3 8 the Permitted Use Table in Chapter 3.
