Cabarrus County Zoning Ordinance <br />Chapter 8- Conditional Uses <br />All zones <br />Section I Purpose <br />The purpose of this Section 2-& is to: <br />• Protect residential areas and land uses from potential adverse impacts of towers <br />and antennas; <br />• Encourage the location of towers in non - residential and less developed areas; <br />• Strongly encourage joint use of new and existing tower sites as a primary option <br />rather than construction of additional single -use towers; <br />• Encourage users of towers and antennas to locate them, to the extent possible, in <br />areas where the adverse impact on the community is minimal; <br />• Encourage users of towers and antennas to configure them in a way that minimizes <br />the adverse visual impact of the towers and antennas through careful design, <br />siting, landscape screening, and innovative camouflaging techniques; <br />• Enhance the ability of the providers of telecommunications services to provide such <br />services to the community quickly, effectively, and efficiently; <br />• Consider the public's health and safety in regard to communication towers; and <br />• Avoid potential damage to adjacent properties from tower failure through <br />engineering and careful siting of tower structures. <br />Section 2 Definitions <br />The words, terms and phrases shall have the meanings assigned below provided, <br />however, any words, terms or phrases not defined herein shall have the meaning <br />assigned in Chapter 2 of this Ordinance: <br />ACCESSORY EQUIPMENT STRUCTURE- A building or cabinet -like structure located adjacent <br />to, or in the immediate vicinity of, a wireless telecommunication tower or antenna to <br />house equipment customarily incidental to the receiving or transmitting of wireless <br />broadcasts, cellular telephone calls, voice messaging and paging services. <br />ALTERNATIVE TOWER STRUCTURE- Man -made trees, clock towers, bell steeples, light <br />poles and similar alternative- design mounting structures that camouflage or conceal the <br />presence of antennas or towers. <br />ANTENNA- Equipment used for transmitting or receiving radio frequency signals, which is <br />attached to a tower, building or other structure, usually consisting of a series of directional <br />panels, microwave or satellite dishes, or omnidirectional "whip" antenna. <br />ANTENNA, STEALTH- Wireless telecommunication antenna and related equipment <br />designed to blend into the surrounding environment or integrated into the physical <br />structure to which it is attached. <br />BASE TRANSCEIVER STATION- Equipment that provides the link between wireless <br />communications and land -based public telephone switching networks, including radio <br />frequency transceivers, back -up power sources, power amplifiers, and signal processing <br />hardware, typically contained in a small building or cabinet. <br />COMMUNICATIONS TOWER- A tower, which supports communication (broadcast, <br />receiving, or relay) equipment, utilized by government or other public and quasi - public <br />users. This does not include private home use of satellite dishes and television antennas <br />or amateur radio operators as licensed by the Federal Communications Commission (FCC). <br />Chapter 8 Page 27 of 35 <br />Attachment number 5 <br />G -1 Page 261 <br />
