Cabarrus County Zoning Ordinance <br />Chapter 8- Conditional Uses <br />ESSENTIAL SERVICES- Wireless telecommunications towers and jntenna� shall be <br />regulated and permitted pursuant to this chapter and shall not be regulated or <br />permitted as essential services, public utilities, or private utilities. <br />SIGNS- Signs on a tower, or on any portion of the premises leased for wireless <br />communication use, shall be limited to those needed to identify the property and <br />the owner and to warn of any danger. Signs which advertise for commercial <br />purposes are prohibited. All signs shall comply with the requirements e€ the Sign <br />Regulatien-s of Chapter 11, Signag . <br />Section 6 Permit Requirements <br />No wireless telecommunications tower or antennae shall be erected or established unless <br />and until a Zoning Clearance permit has been issued pursuant to this Ordinance. <br />A Stealth which does not exceed sixty -five (65) feet in height is permitted as of <br />right and does not require a conditional use permit <br />In addition to procedures, standards and criteria set forth in this Ordinance, conditional <br />use permits for towers and antenna, shall be issued in accordance with the following <br />provisions: <br />Towers or antennas sixty -five (65) feet or more from the average ground level shall <br />require a conditional use permit. This applies to mounted antenna -,, referring to the total <br />height from the base of the building or other structure to the top of the antenna- <br />Any information of an engineering nature that the applicant submits, whether civil, <br />mechanical, or electrical, shall be certified by a professional engineer licensed in the State <br />of North Carolina. <br />In addition to any other information required pursuant to this Ordinance, applications for <br />conditional use permits for towers shall include the following information: <br />a. A site plan consistent with the procedures of this Ordinance which clearly indicates <br />the location, type, and height of the proposed tower; on -site land uses and zoning; <br />adjacent land uses and zoning (including when adjacent to other zoning <br />jurisdictions); adjacent roadways; proposed means of access; setbacks from <br />property lines elevation drawings of the proposed tower and any other structures; <br />and other information deemed by the Administrator to be necessary to assess <br />compliance with this Section. <br />b. The setback distance between the proposed tower and the nearest residential unit <br />and residentially zoned properties. <br />c. The availability of suitable existing towers, other structures, or alternative <br />technology. <br />d. The separation distance from other towers pursuant to Table 1 shall be shown on <br />an updated site plan or map. The applicant shall also identify the type of <br />construction of the existing tower(s) and the owner /operator of the existing <br />tower(s), if known. <br />e. Method of fencing and finished color and, if applicable, the method of camouflage <br />and illumination. <br />f. A notarized statement by the applicant as to whether construction of the tower will <br />accommodate co- location of additional jntennas for future users. <br />Chapter 8 Page 30 of 35 <br />Attachment number 5 <br />G -1 Page 264 <br />
