Cabarrus County Zoning Ordinance <br />Chapter 8- Conditional Uses <br />however that the Zoning Administrator, and /or his or her designee, is not, by <br />sharing such information, in any way representing or warranting that such sites are <br />available or suitable. <br />Section 5 Aesthetics <br />a. Towers shall either maintain a galvanized steel finish or be painted a neutral color <br />so as to reduce visual obtrusiveness. <br />b. The design of the buildings and related structures shall, to the extent possible, use <br />materials, colors, textures, screening, and landscaping that will blend them into the <br />natural setting and surrounding buildings located adjacent to the tower or antenna <br />site. <br />c. If an antenna is installed on a structure other than a tower, the antenna and <br />supporting electrical and mechanical equipment must be of a neutral color that is <br />identical to, or closely compatible with, the color of the supporting structure. This <br />is in order to make the antenna, and related equipment, as visually unobtrusive as <br />possible. <br />d. LIGHTS- No tower or antenna shall have affixed or attached to it in any way <br />except during time of repair or installation, any lights, reflectors, flashers, day -time <br />strobes or steady night time light or other illumination devices, except as required <br />by the FAA, FCC or the County. This restriction against lights shall not apply to <br />towers which have been combined with light standards for illumination of ball field, <br />parking lots, playgrounds, or other similar public uses. If lighting is required, the <br />lighting sources and design shall be designed to create the minimum practicable <br />penetration of areas outside the boundaries of the Lot or Parcel. <br />e. STATE OR FEDERAL REQUIREMENTS- All towers and - �ntennat must meet or <br />exceed current standards and regulations of the FAA, the FCC, and any other state <br />or federal government agency with the authority to regulate towers and antennas. <br />If such standards and regulations are changed, then the owners of the towers and <br />antennas governed by this chapter shall bring such towers and antennas into <br />compliance with the revised standards and regulations within six (6) months of the <br />effective date of such standards and regulations, unless a different compliance <br />schedule is mandated by the controlling state or federal agency. Failure to bring <br />towers and antennas into compliance with such revised standards and regulations <br />shall constitute grounds for the removal of the tower or antenna at the owner's <br />expense. <br />f. BUILDING CODES, SAFETY STANDARDS- To ensure the structural integrity of <br />towers and antennas, the owners of such facilities shall ensure that they are <br />maintained in compliance applicable with standards contained in the State Building <br />Code. <br />g. FALL ZONE- Towers shall be designed so that in the event of a structural failure, <br />the tower falls on the subject parcel or within the leased area of the subject parcel. <br />No tower or antenna shall be designed and /or sited such that it poses a potential <br />hazard to nearby residences or surrounding properties or improvements. To this <br />end, any tower or antenna, not located a distance equal to the height of the tower <br />plus 50 feet away from all property lines or other towers, shall be designed to <br />withstand the maximum forces expected from wind and ice when the tower is fully <br />loaded with antennas, transmitters and other equipment. Compliance with this <br />requirement shall be certified by a professional engineer licensed by the State of <br />North Carolina in a report describing the tower structure, specifying the number <br />and type of antennas it is designed to accommodate, providing the basis for the <br />calculations done, and documenting the actual calculations performed. <br />Chapter 8 Page 29 of 35 <br />Attachment number 5 <br />G -1 Page 263 <br />
