MEMORANDUM <br />To: Cabaxrus County Board of Commissioners <br />From: Kassie G. Watts, AICP /Senior Planner <br />Subject: Consent Agreement and School Capacity Information for Meridian Subdivision <br />Date: 12/20/2010 <br />The Meridian subdivision was approved by the City of Concord Planning and Zoning Board on October <br />19, 2004. The project consists of 16 single- family residential lots on +/- 8.9 acres located off Roberta <br />Road The specifics of the agreement are as follows: <br />• Developer - Guelaguetza Homes, LLC, 4175 Amarillo Drive, Concord, NC 28027. <br />• Payment of $4,034.00 per lot payable prior to platting. <br />• A Consent Agreement for this project was approved by the Board of Commissioners on <br />November 15, 2004. The Consent Agreement was renegotiated on June 18, 2007. The <br />renegotiated Consent Agreement, however, was never executed by Roberta Road, LLC. <br />• All 16 lots in the project were final platted wath the City of Concord on November 9, 2007. <br />• Mr. Zandate, owner of Guelaguetza Homes, LLC, purchased the Meridian project in August of <br />2010 and is ready to proceed with building permitting and construction <br />• Mr. Zandate is requesting that the required Voluntary Mitigation Payment be allowed at building <br />permitting, instead of in one lump stun prior to permitting, since all of the lots have already been <br />platted with the City of Concord (See attached letter from Mr. Zandate) <br />The APFO worksheet filled out by Mr. Robert Kluttz with Cabaunus County Schools indicates that <br />schools impacted by the Meridian subdivision are currently functioning at the following capacities: <br />Pitts School Road Elementary School - 104.94% <br />J.N. Fries Middle School - 109.68% <br />Hickory Ridge High School - 96.21% <br />Incluading previously approved subdivisions and additional capacity from funded improvements in the <br />2009 -2010 Capital Improvement Plan (CIP), these schools will be functioning at the following capacity <br />upon completion of the Meridian subdivision <br />Pitts School Road Elementary School - 140.01% <br />Hickory Ridge Middle School - 89.44% (with the closing of JN Fries at end of 2010 -2011 school year) <br />Hickory Ridge High School - 111.10% <br />The Capital Improvement Plan (CIP) does not include improvements to provide capacity relief at Pitts <br />School Road Elementary School- <br />J.N. Fries Middle School will be closing at the end of the 2010 -2011 school year as a traditional middle <br />school. Beginning in August 2011, J.N. Fries will house a STEM Magnet program and the Performance <br />Learning Center. Approximately 575 students from J.N. Fries are proposed to be transferred to the new <br />Harold Winkler Middle School, projected to open in August 2011. Students from the Meridian project will <br />be assigned to Hickory Ridge Middle School for the 2011 -2012 school year. <br />The CIP does not include improvements that to provide additional capacity relief at Hickory Ridge High <br />School. <br />Cabarrus County Schools operating at 110% capacity are considered to be operating at the tmaximtun <br />capacity.
