The Grant Recipient shall provide or otherwise ensure that the matching funds identified in <br />Exhibit B are provided to the project. <br />2. The Project Site, including real properties on which vegetated riparian buffers are provided, <br />shall be protected permanently by legal instruments conforming to NCGS Chapter 121, <br />Article 4, and NCGS Chapter I I3A, Article 18 (see Exhibit I and paragraph 7 of this Grant <br />Contract for details). The Grant Recipient shall obtain letters of intent from property owners identified in the <br />Schedule of Property Interest to be Acquired indicating each owner's intent to enter into a <br />permanent conservation agreement of land -use restrictions to protect portions of properties <br />needed to implement this Project. Such letters shall describe the property and, to the extent <br />practical, the portion of the property to be protected, shall state that the owner intends to <br />enter into a permanent conservation agreement (conservation easement or other approved <br />instrument) to protect land that is part of the Project Site, and shall be signed by the property <br />owner. The Grant Recipient shall submit the letters of intent to the Fund. The Fund shall <br />approve the Grant Recipient's requests for payment of any costs only after receiving all such <br />letters of intent. <br />4. Permanent land protections needed to implement the Project shall be in the form of recorded <br />permanent conservation agreements (conservation easements or other approved instrument) <br />that name a "holder" (per NCGS Chapter 121, Article 4) with rights of enforcement of the <br />terms of the agreements and name the State of North Carolina as having third -party rights of <br />enforcement. <br />5.
