Watts /Senior Planner <br />Subject: Adequate Public Facilities Mtigation Agreement (APFMA) Request for the Forest Park <br />Crossing Apartment Project <br />Date: 2/18/2011 <br />Forest Park Crossing. LLC (709 North Main Street, Aynor, SC 29511) is requesting an Adequate <br />Public Facilities Mtigation Agreement for the Forest Park Crossing Apartment project, which <br />consists of 56 multi- family units on + /- 11.16 acres located off Little Texas Road in the City of <br />Kannapolis, North Carolina <br />A Development Order and site plan approval for the Forest Park Crossing Apartment project was <br />issued by the City of Kannapolis Technical Review Committee on February 4, 2011. (See attached <br />letter) <br />The Cabanas County Board of Commissioners approved a Reservation of Capacity for the Forest <br />Park Crossing Apartment project on June 21, 2010 subject to the following conditions: <br />Reservation of Capacity Terms of Approval <br />1. This Certificate applies to the development of no more than 56 multi- family apartments on <br />the followingparceL• 5623 -24 -6380. <br />2. Forest Park Crossing, LLC shall adhere to the following build out schedule. <br />In fall 2010, no more than 56 rr alti- family apartment unit permits issued. <br />3. Forest Park Crossing. LLC shall pay the Voluntary Mitigation Payment of $3,678.00 per <br />multi- family apartment unit, for all 56 units in a lump sum payment of $205,968.00 prior to <br />the issuance of the first building permit. <br />4. This Certificate shall be valid for one year, beginning on the date of approval, June 21, 2010, <br />granted by the Cabanas County Board of Commissioners. <br />An Adequate Public Facilities Mitigation Agreement is required for the project to proceed. <br />Board of Commissioner Action Option: <br />Consider approval of the Adequate Public Facilities Mitigation Agreement with the conditions <br />outlined below. <br />1. All 56 multi- family apartment unit permits may be issued as early as fall 2010. <br />2. Forest Park Crossing, LLC shall pay the Voluntary Mitigation Payment of $3,678.00 per <br />multi- family apartment unit.
