�I <br />CABARRUSCOUNTY <br />RESERVATION OF CAPACITY CERTIFICATE <br />(Forest Park Crossing) <br />Pursuant to the authority granted to Cabarrus County by the North Carolina <br />General Assembly as expressed specifically in N.C. Gen. Slat. § 153A -320 N.C. Gen. <br />Slat. §153A -331, N.C. Gen. Slat. §15A -340, Session Law 2004 -39 (as applicable) and <br />Article 15 of the Cabarrus County Zoning Ordinance, the Cabarrus County Board of <br />Commissioners, at its regular meeting on June 21, 2010, approved issuances of this <br />Reservation of Capacity Certificate to Forest Park Crossing, LLC for Forest Park <br />Crossing, which is a residential apartment project consisting of 56 multi- family units on <br />approximately 11. 16 acres located off Little Texas Road in the City of Kannapolis, North <br />Carolina. <br />This Certificate of Reservation of Capacity is issued pursuant to the following <br />conditions contained in the Ordinance and approved by the Board of Commissioners: <br />1. This Certificate applies to the development of no more than 56 multi- <br />family apartments on the following parcel: 5623 -24 -6380. <br />2. Forest Park Crossing, LLC shall adhere to the following build out <br />schedule: <br />In fall 2010, no more than 56 multi- family apartment unit permits issued; <br />3. Forest Park Crossing, LLC shall pay the Voluntary Mitigation Payment of <br />$3,678.00 per multi- family apartment unit, for all 56 units in a lump sum payment of <br />$205,968.00 prior to the issuance of the first building permit. <br />4. This Certificate shall be valid for one year, beginning on the date of <br />approval, June 21, 2010, granted by the Cabarrus County Board of Commissioners. <br />This 45 day of June, 2010. <br />J 'NATHAN B.
