to the County representative's attention in writing at least five (5) days prior to the <br />opening of the bid. <br />2.6 Contract types: <br />(A) Definite Quantity: A definite quantity contract is a fixed -price contract that <br />provides for delivery of a specified quantity of supplies or services either at <br />specified times or when ordered. <br />(B) Indefinite Quantity: An indefinite quantity contract is a contract for an <br />indefinite amount of supplies or services to be furnished at specified times, <br />or as ordered, that establishes unit prices of a fixed -price type. Generally, an <br />approximate quantity or the best information available as to quantity is stated <br />in the Invitation to Bid. The contract may provide a minimum quantity the <br />County is obligated to order and may also provide for a maximum quantity <br />provision that limits the County obligation to order. <br />Note: This is a DEFINITE Quantity contract. <br />2.7 Prices to be Firm: Bidder warrants the bid price(s), terms and conditions quoted in <br />their bid shall be firm for acceptance by the County for a period of one hundred <br />twenty (120) days from the bid receipt deadline. Do not include taxes in bid figures. <br />The County pays sales tax which should be added to invoices. The County is <br />exempt from Federal Excise Tax and will issue a Federal Exemption Certificate, if <br />necessary. <br />2.8 Description of Material: Proposals for materials, supplies, vehicles, and /or <br />equipment must be accompanied by accurate descriptions of the exact materials, <br />supplies, vehicles, and /or equipment on which a bid(s) is made. When specified in <br />the Invitation to Bid, copies of detailed factory specifications, ratings, technical data, <br />etc. may be required for submittal along with the bidder's response package. <br />2.9 Completeness: All information required by Request for Bid must be completed and <br />submitted to constitute a proper bid. <br />2.10 Quality: All components used to manufacture or construct any supplies, materials <br />or equipment covered in this Invitation to Bid shall be new (unless otherwise <br />specified), the latest model, of the best quality and highest grade workmanship. <br />Vehicles and /or equipment shall be equipped with such necessary equipment <br />complying with the North Carolina law, but not including licensing. Materials must <br />comply with all applicable Federal and State OSHA requirements in affect at the <br />time this Invitation to Bid is issued. <br />2.11 Acceptance of Goods /Services: <br />Goods delivered under this Invitation to Bid shall remain the property of the <br />successful bidder until a physical inspection and actual usage of this material and /or <br />services is made and therefore accepted to the satisfaction of the County.
