LOMAX and VERNA S. LOMAX, together douig business as <br />Lomax Enterprises, (collectively referred to as "Lessor"} and CABARRUS COUNTY, a body <br />politic and political subdivisiorrofthe State ofNorth,/arolina (refereed to`as "Lessee"): <br />WITNESSETH: <br />In consideration of the rents agreed to be paid and in consideration of the mutual <br />covenants and agreements recited, Lessor does lease and demise unto Lessee and Lessee does <br />lease and take as tenant fiorri Lessor those certaut premises (referred to as "Premises") <br />collectively consisting of a) a four bedroom, three bath home in a block building located at 3459 <br />Atando Road, permitted and used as a residence; b) a three bedroom, one bath house trailer <br />located at 3435 Atando Road permitted and used as a residence, and an office for Lomax <br />Enterprises c) an operating 600 foot deep water well and well house; d) a trvo-car metal sheathed <br />pole style garage/barn (all collectively refereed to as the "Buildings") on approximately 1.0 acre <br />of land having the above two addresses on Atando Road, Concord, in the County of Caban•us, <br />North Carolina (referred to as "Land"). The Land is described in a deed recorded in Deed Book <br />3741, page 239 of the Cabarrrrs Public Registry and is shown in a map attached as Exhibit A to <br />this Lease. In partial consideration for this Lease Agreement, the Lessee has granted a perpetual <br />easement for those parts of the existing septic tank and septic drain field that lie within the <br />Lessee's property. That perpetual, transferable easement will be recorded in the Cabarrus Public <br />Registry and a copy is attached to this Lease Agreement. Lessor shall have no obligation to make <br />any improvements in the Premises whatsoever and Lessee hereby agrees to accept the same in its <br />present condition, "as is". <br />TO HAVE AND TO HOLD the Premises unto the Lessee upon the following terms and <br />conditions: <br />1. TERM. The term of this Lease shall begin on the 15` day of October, 2009, and <br />shall end at 12:00 midnight on the 30th day of September, 2010.
