CONTRACT TO PROVIDE TAX DISTRICT FIRE SERVICE <br />NORTH CAROLINA <br />CASARRUSCOUNTY <br />This contract made and entered into this 1st day of July 2009, by and between the <br />Enochville Fire Department (DEPARTMENT), anon-profit corporation, and the County <br />of Cabarrus (COUNTY}; <br />WITNESSETH: <br />That for and in consideration of the mutual covenants hereinafter contained, and pursuant <br />to authority granted by G.S. 69-25.5, G.S. 69-25.6, and G.S. I53A-233, the <br />DEPARTMENT and the COUNTY do hereby covenant and agree as follows; <br />I. The COUNTY agrees to annually levy and collect upon all taxable property <br />lying within the COUNTY boundaries of the Enochville Rural Fire Protection Tax <br />District an ad valorem property tax equal to .06 cents per one hundred ($100.00) <br />valuation, and after deduction of the COUNTY's administrative charge (1 %z%} for <br />collection of such taxes, to pay the same to the DEPARTMENT. All monies collected <br />'will be paid to the DEPARTMENT regardless of actual dollars budgeted. <br />2. The Tax Collector of the COUNTY shall collect the ad valorem taxes so levied <br />and shall make payments of the same to the DEPARTMENT monthly as collections are <br />made. <br />3. The DEPARTMENT agrees to furnish and provide continuing fire protection <br />service to all property lying within the Cabarrus County boundaries of the Enochville <br />Rural Fire Protection District by dispatching upon call any or all of its equipment and <br />adequate personnel to operate same. The DEPARTMENT shall furnish fire protection <br />services in a professional and efficient manner as to meet the requirements of and comply <br />with rules and regulations of the NC Office of State Fire Marshal, other pertinent federal, <br />state, and COUNTY laws, regulations, and standards. The DEPARTMENT agrees to <br />operate vtnthin the guidelines set forth in Article II of Chapter 34, Fire Prevention and. <br />Protection, of the Cabarrus County Code of Ordinances, attached to this contract. <br />4. The DEPARTMENT shall participate, within the limits of its personnel and <br />equipment resources and capabilities and with deference to its primary responsibility, in <br />any county-wide, inter-county, or county-municipality mutual aid or interlocal. agreement <br />entered into by the COUNTY. <br />5. The DEPARTMENT agrees to, when alerted far automatic aid, respond v~rith a <br />piece of fire apparatus capable of carrying a minimum of 1, 000 gallons of water to any <br />six (6) mile Fire District that is in geographical proximity of its district as in accordance <br />Attachment number 2 <br />F-2 Page 53 <br />
