RESOLUTION APPROVING CONVEYANCE OF PROPERTY <br />PURSUANT TO G.S. 160A -279 <br />WHEREAS, the Cabarrus County owns a 30 -acre unimproved tract of land <br />between Warren C. Coleman Boulevard, Cabarrus Avenue West and Brown Street in <br />Concord, North Carolina; and <br />WHEREAS, North Carolina General Statute § 160A -279 authorizes a county to <br />convey real property by private sale to a nonprofit corporation, if the county is <br />authorized by law to appropriate money to the corporation; and <br />WHEREAS, North Carolina General Statute § 153A -378 authorizes a county to <br />convey property by private sale to any public or private entity that provides <br />affordable housing to persons of low or moderate income; and <br />WHEREAS, Habitat for Humanity Cabarrus County, Inc., is a non - profit <br />corporation within the meaning of North Carolina General Statute §160A -279 and <br />§153A -378. <br />WHEREAS, Cabarrus County has negotiated with Habitat for Humanity <br />Cabarrus County, Inc., at no dollar cost, to convey the 30 acre tract described above <br />to Habitat for Humanity Cabarrus County, Inc. for development of an affordable <br />housing community. <br />NOW, THEREFORE, THE BOARD OF COMMISSIONERS OF CABARRUS COUNTY <br />RESOLVES THAT: <br />1. The County Manager is authorized to execute all documents necessary to <br />convey fee simple title to Habitat of Humanity Cabarrus County, Inc. of a 30 -acre <br />tract of land between Warren C. Coleman Boulevard, Cabarrus Avenue West and <br />Brown Street in Concord, North Carolina (PIN #s 5620234056, 5620238271, <br />5620229833 and 5620211889). <br />2. The consideration for the conveyance is the following set of conditions, <br />covenants, and restrictions, which shall be incorporated in the deed given by the <br />County to Habitat for Humanity Cabarrus County, Inc: <br />a) The property shall only be used for development of an affordable housing <br />community consisting of only single family dwellings; and <br />b) Habitat for Humanity Cabarrus County, Inc., shall only convey the <br />property or any portion of the property to those individuals who have been admitted <br />into and successfully completed Habitat's home owner program. <br />3. The Clerk to the Board shall publish a notice summarizing the contents of <br />this resolution, and the property may be conveyed at any time after 10 days after <br />publication of the notice. <br />ADOPTED this the 20 day of September, 2010. <br />Aft number 2 <br />F -2 <br />
