Runkel <br />Womble Carlyle Sandridge & Rice, PLLC <br />3500 One Wachovia Center <br />301 South College Street <br />Charlotte, NC 28202 <br />STATE OF NORTH CAROLINA <br />EASEMENT AGREEMENT <br />COUNTY OF CABARRUS <br />THIS EASEMENT AGREEMENT ( "Agreement ") is made and entered into this <br />day of , 2010, by and between CABARRUS COUNTY, having a <br />mailing address of <br />( "Grantor"), and TOWN OF HARRISBURG, a corporate body formed under the laws of <br />North Carolina ( "Grantee "). <br />STATEMENT OF PURPOSE <br />Grantor is the owner of certain real property located in Cabarrus County, North <br />Carolina and more particularly identified on Exhibit A attached hereto ( "Grantor's <br />Property"). Grantee is a municipality located in Cabarrus County, North Carolina, <br />having responsibility for the provision of certain utility services within its borders. The <br />parties hereto desire to provide for (1) an access easement, (2) a sanitary sewer easement, <br />(3) a drainage easement, and (4) a utility easement, each over, across and/or within <br />different portions of Grantor's Property in accordance with the terms and conditions set <br />forth herein, it being anticipated that Grantee shall make use of such access and easement <br />rights, including without limitation for the provision of certain utility services to the <br />Hickory Ridge Middle School (described/depicted in Exhibit B ). <br />AGREEMENT <br />NOW, THEREFORE, in consideration of the <br />Dollar ($1.00) paid by Grantee and other valuable <br />sufficiency of which is hereby acknowledged, Granto r <br />follows: <br />WCSR 44127420 <br />foregoing statements and One <br />consideration, the receipt and <br />and Grantee hereby agree as <br />A40" number 1 <br />F -4 <br />
