Page 5 of 11 exercises any function or responsibilities in the review or approval of the Project or any component part thereof, shall participate in any decisions relating to this contract which may affect his personal interest or the interest of any corporation, partnership or association in which he is, directly or indirectly, interested; nor shall any such person have any interest, direct or indirect, in this contract or the proceeds arising there from. 20. Officials Not to Benefit No member of or delegate to the Congress of the United States of America, resident Commissioner or employee of the North Carolina State Government, shall be entitled to any share or part of this contract or any benefits to arise here from. 21. Certification Regarding Nondiscrimination The county shall comply with all federal and state laws relative to equal employment opportunities. 22. Assurances The Agency, by and through the undersigned authorized representative hereby certifies that the Agency: (a) Has the legal authority to apply for Federal assistance, and the institutional, managerial and financial capability (including funds sufficient to pay the non - Federal share of project costs) to ensure proper planning, management and completion of the project described in its application for funds and this contract. (b) Will give the awarding agency, the Comptroller General of the United States, and if appropriate, the State, through any authorized representative, access to and the right to examine all records, books, papers, or documents related to the award; and will establish a proper accounting system in accordance with generally accepted accounting standards or agency directives. (c) Will establish safeguards to prohibit employees from using their positions for a purpose that constitutes or presents the appearance of personal or organizational conflict of interest, or personal gain. (d) Will initiate and complete the work within the applicable time frame after receipt of approval of the awarding agency. (e) Will comply with the Intergovernmental Personnel Act of 1970 (42 U.S.C. §§ 4728 - 4763) relating to prescribed standards for merit systems for programs funded under one of the nineteen statutes or regulations specified in Appendix A of OPM's Standards for a Merit System of Personnel Administration (5 C.F.R. 900, Subpart F).
