MEMORANDUM <br />To: Cabarrus County Board of Commissioners <br />From: Kassie G. Watts /Senior Planner <br />Subject: Adequate Public Facilities Mitigation Agreement Request for Olive Woods <br />Date: 10/21/2010 <br />Wayne Cline, acting as POA for Emily R. Cline, (2300 Sunset Road, Charlotte, NC 28216) is <br />requesting an Adequate Public Facilities Mitigation Agreement (APFMA) for the Olive Woods <br />residential subdivision project, which consists of 5 single family units on +/- 25.17 acres located off <br />Mt. Olive Road in unincorporated Cabarrus County, North Carolina. The project received a <br />preliminary plat approval from the Cabarrus County Planning and Zoning Commission on October <br />21, 2010. <br />The Cabarrus County Board of Commissioners approved a Reservation of Capacity for the Olive <br />Woods subdivision project on October 18, 2010 subject to the following conditions: <br />Reservation of Capacity Terms of Approval <br />1. This Certificate applies to the development of no more than 5 units on the following parcels: <br />(1) 5683 -20 -3989 & (2) 5683 -10 -8222 <br />2. Wayne Cline, acting as POA for Emily R. Cline, will not be required to adhere to a build out <br />schedule. <br />3. Wayne Cline, acting as POA for Emily R. Cline, will not pay the Voluntary Mitigation <br />Payment. <br />4. This Certificate shall be valid for one year, beginning on October 18, 2010, the date of <br />approval as granted by the Cabarrus County Board of Commissioners. <br />Board of Commissioner Action Option: <br />Consider approval of the Adequate Public Facilities Mitigation Agreement with the conditions <br />outlined below: <br />1. Wayne Cline, acting as POA for Emily R. Cline, will not be required to adhere to a build out <br />schedule in connection with the approval represented by the Reservation of Capacity <br />Certificate granted on October 18, 2010. <br />2. Wayne Cline, acting as POA for Emily R. Cline, will not be required to pay the Voluntary <br />Mitigation Payment in connection with the approval represented by the Reservation of <br />Capacity Certificate granted on October 18, 2010. <br />Authorize the County Manager to execute the Agreement on behalf of Cabarrus County, subject to <br />review or revisions by the County Attorney. <br />Attachment number 2 <br />Page 70 <br />F -3 <br />
