<br /> <br /> <br /> <br /> <br />CABARRUS COUNTY <br />BOARD OF COMMISSIONERS <br />REGULAR MEETING <br />MARCH 16, 2009 <br />6:30 P.M. <br />AGENDA CATEGORY: <br />New Business <br />SUBJECT: <br />Commerce -Consent Agreement for the Thompson's Lake Subdivision <br />' Project <br />' BRIEF SUMMARY: <br />The applicant is Flavia Thompson, P. O. Box 88, Midland, NC 28107, and <br />William Brewster Co., Inc., P.O. Box 99, Davidson, NC 28036. The project <br />' consists of 58 single family residential lots on +/-42.72 acres located on <br />Bethel School Road. The project received preliminary plat approval from <br />the Town of Midland on February 6, 2007. The project recently received a <br />' two year preliminary plat extension setting the new expiration date on <br />February 6, 2011. The developer has not previously entered into a <br />' Consent Agreement with the Cabarrus County Board of Commissioners. <br />A Consent Agreement is required for the project to proceed. Based on <br />the original date of preliminary plat submittal, the Voluntary <br />' Mitigation Payment is generated from the pre-August 2007 <br />ordinance. <br />' REQUESTED ACTION: <br />Motion to consider approval of the Consent Agreement between Cabarrus <br />' County and Flavia Thompson and William Brewster Co., Inc. for the <br />Thompson's Lake subdivision project, including the payment of $4,034 per <br />lot to advance school adequacy with payment due prior to final platting. <br />' Authorize the County Manager to execute the Agreement on behalf of <br />Cabarrus County, subject to review or revisions by the County Attorney. <br />EXPECTED LENGTH OF PRESENTATION: <br />5 Minutes <br />' SUBMITTED BY: <br />' Kassie G.
