1 <br /> <br /> Town of Midland Cabarrus County <br /> North Carolina North Carolina <br />' Interlocal Agreement Regarding Fire Code Enforcement <br /> This Agreement made this ist day of July, 2008, by and between Cabarrus County, a <br /> political subdivision of the State of North Carolina, herein called, "County" and the <br /> Town of Midland, a municipal corporation located in Cabarrus County and organized <br /> under the laws of the State of North Carolina, herein "Town". <br />' WITNESSETH: <br /> WHEREAS, North Carolina Fire Prevention Code, formerly the North Carolina <br /> State Building Code Volume Five (V), hereinafter referred to as the Fire Code of the <br />S <br />f <br />' tate o <br />North Carolina, became effective in the County and Town January, 2ooi; and <br /> WHEREAS, County has adequate personnel to provide enforcement of the Fire <br /> Code for the Town as described herein; and <br /> WHEREAS, N.C.G.S. Section i6oA-46i and Section 1b3A-3S3 authorize <br /> counties and towns to enter into interlocal agreements for carrying out joint inspection <br /> services; and <br />' WHEREAS, the Town has, by Resolution requested County to direct one or <br />more of its inspectors to exercise their powers to enforce the Fire Code within the <br />corporate limits of Town, all in accordance with N.C.G.S. i6oA-4i3. <br /> <br />1 <br /> <br /> <br /> <br /> <br /> <br />NOW, THEREFORE, in consideration of the mutual covenants set forth herein <br />and other good and valuable consideration, the receipt of which is hereby <br />acknowledged, the parties agree as follows: <br />i. The term of this Agreement shall be for one year beginning July x, 2008 and <br />ending June 30, 2oog. Unless terminated as provided herein, this Agreement <br />shall automatically renew upon expiration of the first year or any subsequent <br />year for a period of one additional year. <br />2. Either party may terminate this Agreement by giving written notice to the other <br />at least thirty (30) days prior to the termination of the then current Agreement. <br />3. County, through its Fire Services, is designated as the agency to perform <br />inspection duties and responsibilities mandated by the Fire Code within the <br />corporate limits of Town. <br />4. County Fire Services shall receive applications for all permits required by the <br />Fire Code, issue or deny permits, make necessary inspections, issue or deny <br />certificates of compliance, issue orders to correct violations, revoke permits, <br />bring judicial action against actual or threatened violations, keep adequate <br />records and take other action as may be necessary to enforce the Fire Code <br />within the Town. <br />Page i of 2 <br />F-3 <br />Attachment number 1 <br />Page 72 of 199 <br />
