<br /> <br />t Town of Mount Pleasant Cabairus County <br />North Carolina North Carolina <br />' Interlocal Agreement Regarding Fire Code Enforcement <br />The Agreement made this lst day of July, 2008, by and between Cabarrus County, a political <br />subdivision of the State of North Carolina, herein called, "County" and the Town of Mount <br />' Pleasant, a municipal corporation located in Cabarrus County and organized under the laws of <br />the State of North Carolina, herein "Town". <br />' WITNESSETH: <br />WHEREAS, North Carolina Fire Prevention Code, formerly the North Carolina State Building <br />' Code Volume Five (V), hereinafter referred to as the Fire Code of the State of North Carolina, <br />became effective ui the County and Totem 3anuary, 2001; and <br />WHEREAS, County has adequate personnel to provide enforcement of the Fire Code for the <br />Toum as described herein; and <br />WHEREAS, N.C.G.S. Section 160A-461 and Section 153A-353 authorize counties and toti~ms to <br />' enter into interlocal agreements for carrying out joint inspection services; and <br />WHEREAS, the To~~~n has, by Resolution requested County to duect one or more of its <br />t inspectors to exercise their powers to enforce the Fire Code within the corporate limits of Town, <br />all in accordance with N.C.G.S. 160A-413. <br />' NOW, THEREFORE, in consideration of the mutual covenants set forth herein and other good <br />and valuable consideration, the receipt of which is hereby acknowledged, the parties agree as <br />follows: <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />1. The tern of this Agreement shall be for one year beginning July 1, 2008 and ending June <br />30, 2009. Unless terminated as provided herein, this Agreement shall automatically <br />renew upon expiration of the first year or any subsequent year for a period of one <br />additional year. <br />2. Either pax•ty may terminate this Agreement by giving written notice to the other at least <br />thirty (30) days prior to the tertninatian of the then cturent Agreement. <br />3. County, through its Fue Services, is designated as the agency to perforn inspection <br />duties and responsibilitiesrnandated by the Fire code ~>>ithin the corporate limits of To~am. <br />4. Comity Fire Sei•~~ices shall receive applications for atl permits required by the Fue Code, <br />issue or deny permits, make necessary inspections, issue or deny certificates of <br />compliance, issue orders to coi7ect violations, revoke permits, bring judicial action <br />against actual or tlueatened violations, keep adequate records and take other action as <br />may be necessary to enforce the Fire Coda within the Town. <br />5.
