The Owner shall provide professional credit <br />for the Architect in the Owner's pro-notional materials for the Project. <br />§ 7.8 If the Architect or Owner receives information specifically designated by the other party as "confidential" or <br />"business proprietary," the receiving party shall keep such information strictly confidential and shall not disclose it <br />to any other person except to (1) its employees, (2) those who need to know the content of such information in order <br />to perform services or construction solely and exclusively for the Project, or (3) its consultants and contractors <br />whose contracts include similar restrictions on the use of confidential information. <br />~7 9 ADA COMPLIANCE As the American with Disabilities Act (ADA) is primarily a law concerning Civi) <br />Rights and Civil Legislation Architects are not knowledgeable concermng all of the possrble -nterpretadons of this <br />document Therefore when complete the facility may or may not be fully ADA compltant. As such the Architects <br />will comply with the current 2009 Edition of the NC State Building Code (2006 International Butldtng Code (IBC) <br />with North Carolina Amendments) The Architect shall also utilize the 1999 Edtt-on of the North Caroltna State <br />Accessibilit Buildin Code with 2002 and 2004 Amendments. The A-•ch-tect can and w-11 utilize these documents <br />as its full responsibility conce-ning accessibility to the Owner for the Proiect. <br />Should the Owner wish to rovide total com liance with the ADA the Architect recommends that the Owner retains <br />a qualified ADA Consultant who has specific and total knowledge regardin¢ requirements and interpretations of the <br />A-nericans with Disabilities Act. <br />ARTICLE 8 SPECIAL TERMS AND CONDITIONS <br />Special terms and conditions that modify this Agreement are as follows: <br />ARTICLE 9 SCOPE OF THE AGREEMENT <br />§ 9.1 This Agreement represents the entire and integrated agreement between the Owner and the Architect and <br />supersedes all prior negotiations, representations or agreements, either written or oral.
