§ 5.3 In preparing estimates of the Cost of Work, the Architect shall be permitted to include contingencies for <br />design, bidding and price escalation; to determine what materials, equipment, component systems and types of <br />construction are to be included in the Contract Documents; to make reasonable adjustments in the program and <br />scope of the Project; and to include in the Contract Documents alternate bids as may be necessary to adjust the <br />estimated Cost of the Work to meet the Owner's budget for the Cost of the Work. The Architect's estimate of the <br />Cost of the Work shall be based on current area, volume or similar conceptual estimating techniques. If the Owner <br />requests detailed cost estimating services, the Architect shall provide such services as an Additional Service under <br />Article 3. <br />§ 5.4 If the Bidding or Negotiation Phase has not commenced within 90 days after the Architect submits the <br />Construction Documents to the Owner, through no fault of the Architect, the Owner's budget for the Cost of the <br />Work shall be adjusted to reflect changes in the general level of prices in the applicable construction market. <br />§ 5.6 If the Owner's budget for the Cost of the Work at the conclusion of the Construction Documents Phase <br />Services is exceeded by the lowest bona fide bid or negotiated proposal, the Owner shall <br />.1 give written approval of an increase in the budget for the Cost of the Work; <br />.2 authorize rebidding or renegotiating of the Project within a reasonable time; <br />.3 terminate in accordance with Section 5.5 of AIA Document B 102-2007; <br />,4 in consultation with the Architect, revise the Project program, scope, or quality as required to reduce <br />the Cost of the Work; or <br />.5 implement any other mutually acceptable alternative. <br />§ 5.7 If the Owner chooses to proceed under ~ ~ h;~l <br />~ - 7 f rl. !' .,~r...,..r: ~.., ileG r Dl, C rL. 1. .i r .i' t .i .i C ..r:.,., ~ ~ 1 Tt.e <br />~v},•r ~ r~ "F' r' - f rl !` r r' Tl .,tom sta,p]]..)'a° r~_-'r f rM A l,'r r~ .,..., ~:L.:l:r., dnr_tly$ <br />,4rt~3:Article 5 6 1 5 the Architect will be compensated commensurate with the effort required and as mutually <br />negotiated with Owner to perform any services desired by the Owner as defined in those articles. <br />ARTICLE 6 COMPENSATION <br />§ 6.1 For the Architect's Basic Services described under Article 2, the Owner shall compensate the Architect as <br />follows: <br />(Insert amount of, or basis for, compensation.) <br />BASIC SERVICES /BASIC SERVICES CREDIT <br />Compensation will be based on 8 75% of construction cost of the proiect as defined in Article 5 -Cost of the Work. <br />For purposes of payment through the course of the proiect project budget will be established at $6,250,000 <br />This budget will remain through the course of the proiect until the proiect either competitively bids by the Owner's <br />Construction Manager or the~roiect is abandoned The most current estimate of expected cost provided by either <br />the Owner's Construction Manager or Architect shall prevail or govern. <br />In either scenario the compensation will be adjusted up or down at the conclusion of Competitive Bidding of the <br />proiect as defined in Article 2.5.2 <br />Less $12 500 credit to be issued from the reusable portion of the work developed under the Master Planning Scope <br />of Services which was considered as a separate agreement before services The credit will be prorated through out <br />the value of the contract. <br />Pio ress Payments for Basic Services in each Phase shall total $546 875 as per the following percentages: <br />(Excludes Reimbursable Expenses) <br />AIA Document 8201 T"" - 2007 (formerly 8141 TM -1997 Part 2).
