Watts, AICP, Senior Planner <br />Date: July 30, 2009 <br />Case#: C2009-03(SE) <br />Accela#: PLEX2009-00004 <br />Re: <br />Appeal of Request for Extension of Rocky Glen Preliminary Plat Approval <br />Attached, is a letter requesting an extension of the Rocky Glen preliminary subdivision plat. A copy of <br />the approved preliminary plat map is also enclosed. <br />Pursuant to the Cabarrus County Subdivision Ordinance Chapter 3, Section 5A, a preliminary plat <br />approval is valid for a period of 24 months from its approval date. In addition, this project is subject to a <br />Consent Agreement that also expires two years from the preliminary plat approval date. The plat was <br />originally approved by the Cabarrus County Planning and Zoning Commission on July 19, 2007. <br />From information obtained by staff, it appears that the developer does not own the property, yet he <br />obtained an easement from the owners, which he in tom granted to the City of Midland for the Monroe- <br />Midland gas pipeline. The proposed route of the pipeline is across the open area that he promised to <br />the CCSWCD to be used as a conservation easement. It also apparently goes under the entrance <br />road, into the WBOD for the existing pond, under the play area and also extends into the no build <br />buffer for the intermittent stream. Thus, the plat which the developer is requesting an extension is no <br />longer accurate and will need to be changed. <br />The extension request was reviewed by all service providers. The comments received are as follows: <br />City of Concord- Pam Parker: Developer will be required to enter into a developer's agreement with <br />the City of Concord in order to extend public water and sewer mains. The developer's agreement will <br />cover stormwater standards. Please ensure that your project will be in compliance with Phase II <br />stormwater rotes. <br />Cabarrus County Soil 8~ Water Conservation-Dennis Testerman: See attached memo. <br />Cabarrus County Schools-Robert Klutlz: The subdivision was reviewed for current capacity. Since <br />the original Adequate Public Facilities Worksheet review was completed for this project in 2007, Rocky <br />River Elementary decreased slightly to 112.10%, C.C. Griffin Middle School increased to 129.46%, and <br />Central Cabarrus decreased to 76.09%. These percentages were calculated from the 8"' month <br />membership report. <br />Cabarrus County Health Alliance-David Troutman: No comments. <br />NCDOT-Leah Wagner: Regarding the Rocky Glen project, there are no additional comments.
