Soil 8~ Erosion Control-Thomas Smith: An erosion and sedimentation control plan has been <br />submitted to this Office and was approved on August 24, 2008. The~roadways plan was approved with <br />modifications on November 7, 2008. The roadways plan shows a proposed sediment basin in an <br />existing pond that is within the RSOZ. Failure to comply and submit a revised erosion control plan <br />could result in this permit being revoked. <br />WSACC-Tom Bach: See attached memo. <br />Cabarrus County Fire MarshalSteven Langer: No comments. <br />At the June 18"', 2009 regularly scheduled Planning and Zoning Commission Meeting, the Board voted <br />to unanimously deny the applicant's request for a one year preliminary plat extension for the Rocky <br />Glen subdivision. The applicant has filed an appeal to the Cabarrus County Board of Commissioners. <br />The board should determine if the applicant has acted in good faith to develop the project in a timely <br />manner. This might include discussion of whether the applicant has prepared construction drawings <br />and received any necessary grading, utility, road, or applicable approvals for the project. If the board <br />finds that the developer has acted in good faith to develop the project, Staff recommends the following <br />conditions be placed on the extension: <br />The developer be granted a one year extension for the development of this project. The new <br />expiration date would be July 19, 2010. <br />2. The extension be conditioned upon the Cabarrus County Board of Commissioners reaffirming <br />or renegotiating the terms of the original Consent Agreement for the Rocky Glen subdivision <br />project. <br />3.
