10. Revise the typical street standards so that they match Cabarrus County's newly adopted typical <br />street standards, which appear in Appendix A of the Zoning Ordinance. (NCDOT/CONCORD) <br />As part of the extension request, Staff is requesting that the following conditions become part of the <br />approval, should the Commission decide to grant the one year extension request. <br />1. The developer is granted a one year extension for the development of this project. The new <br />expiration date is July 19, 2010. <br />2. The extension is conditioned upon the Cabarrus County Board of Commissioners reaffirming <br />or renegotiating the terms of the original Consent Agreement for the Rocky Glen subdivision <br />project. <br />3. All applicable conditions related to the original preliminary plat approval (July 19, 2007) be <br />incorporated into this approval by reference. <br />4. Applicant must submit a revised erosion control plan and provide adequate sedimentation and <br />erosion control measures outside of the River Stream Overlay Zone. Pursuant to Chapter 4 <br />Section 410 of the Cabarrus County Zoning Ordinance no soil disturbing activities are <br />permitted in the River Stream Overlay Zone. <br />Additionally staff suggests the following conditions to address concerns expressed by the Board of <br />Commissioners at the work session: <br />1. Applicant shall, within 90 days from July 19"' 2009, submit a revised plan and preliminary plat <br />application to Planning Services for consideration by the Cabarrus County Planning and Zoning <br />Commission. The revised plan shall address all outstanding review comments and shall clearly <br />show the location of the gas line easement as well as any other required easements or rights-of- <br />way. <br />2. Applicant shall, within 180 days from July 19, 2009, transfer the conservation easement <br />containing approximately 4.534 acres of primary open space, as delineated on the Rocky Glen <br />Preliminary Plat approved by the Cabarrus County Planning and Zoning Commission on July <br />19, 2007 to the Soil and Water Conservation District of Cabarrus County. <br />• Page 2 <br />Attachment number 2 <br />Page 56 of 315 <br />E-1 <br />
