June 2009 - Planning & Zoning Draft Meeting Minutes <br />Mr. Scribner said yes, he has an Erosion Control Permit and has already gone through that <br />process. He said the thing Ms. Watts gave him tonight, he just got and has not looked at any of it <br />and does not know what it is. <br />Mr. Testerman said this does not show that this is a natural area and does not show that it is <br />primary open space and he has not had a chance to consult with Mr. Smith or Mr. Johnson as to <br />what they were seeing on this. As he understands it, the only thing that has been approved so far <br />is less than four acres that is involved in roads; the other stuff has been disapproved. He said one <br />of the comments they made was that the river stream overlay zone needed to be addressed. In <br />looking through the comments that the City of Concord submitted back to Mr. Scribner about a <br />year ago, they also noted the natural features were missing off the plans that they received, and <br />needed to be shown. <br />Mr. Testerman said trying to coordinate within the County and within the city and then across <br />the boundaries as well, as to what is going on. He is not sure that everybody is sitting down with <br />a full set of drawings that show this is the natural area and this is where the conservation <br />easement is going to go, and then how do you work around that with your roads, your lots, your <br />infrastructure, your utilities; whether it is a pipeline, whether it is water and sewer or what ever it <br />is. <br />Ms. Watts clarified that Mr. Scribner does have. an approved Erosion Control Plan. It had been <br />disapproved and then it was approved and Mr. Testerman was writing the word comments about <br />the River/Stream Overlay Zone, that there needed to be some things clarified. It appears that the <br />engineer who resubmitted the drawings indicated that there were areas that been indicated by <br />Soil and Erosion were in fact not in the River/Stream Overlay Zone, which was not correct. She <br />said which is why Mr. Smith went back out into the field this afternoon and did a site assessment <br />and then reissued some additional comments. She said Mr. Smith has not disapproved Mr. <br />Scribers' plan at this time; he has just added additional conditions that his plan will need to be <br />revised. Obviously the areas that show the fill are in the River/Stream Overlay Zone, and that is <br />not allowed. She said turning the farm pond into a sediment basin would certainly not be <br />appropriate. She said there are certainly some things that need to be looked at. <br />Mr. Griffin said that is part of the normal process, sorting those things out right? <br />Ms. Watts would not think so; we will sort things out. <br />The Chair thinks her point is not for us to determine whether it is right or wrong. The issue <br />before us is do we grant the preliminary plat extension. <br />Ms. Watts said we will certainly work things through with Mr. Scribner. He is going through the <br />process, he's turning drawings in. She said this is typical process and there is always a lot of <br />going back and forth. She said he is requesting a subdivision extension and she does not want <br />that to get lost in everything. <br />Mr. Baucom said if Mr. Scribner would have started building houses in March 2008, the <br />economy is good, and we are building houses; the gas line was put in.
