An employee who enters extended active duty with the Armed forces, the Armed Forces Reserve, the
<br />National Guard, or other uniformed services of the United States will be granted reinstatement rights
<br />commensurate with the Uniformed Services Employment and Reemployment Rights Act (USERRA).
<br />Section ~-8t2. Promotion
<br />(a) Candidates for promotion shall be chosen at the basis of their qualifications, and en-their-work
<br />records without regard to age, color, disability, national origin, political affiliation, race, religion, or sex.

<br />(b) Vacancies in positions shall be filled as far as practicable by the promotion of current
<br />County employees. • e-~e , •
<br />(c) If a current County employee is chosen for promotion, the department head shall forward the

<br />make the appointment and determine the classification and starting salary.
<br />Appointing authorities other than the County Manager shall forward the employee's name to the

<br />Section X13, Demotion
<br />Any employee whose work in his present position is unsatisfactory, or whose personal conduct is
<br />unsatisfactory, may be demoted, provided that the employee shows promise of becoming a satisfactory
<br />employee in another position. Such a demotion shall follow the procedures outlined iu Article VII,

<br />strictly voluntary basis subject to approval of the department head and County Manager.
<br />Section -x-314. Transfer
<br />If a vacancy occurs and au employee is eligible for a transfer and is selected, the deparhnent head wishing
<br />to hire the employee shall request the transfer, which is subject to review by the Human Resources
<br />Uirector and fie-approval of the County Manager, except that appointing authorities other than the
<br />County Manager shall make such appointments for their deparhnents. Any employee involuntarily
<br />transferred witFtetr~-l~s-fravi+tg-te~}ttested-i~may appeal the action iu accordance with the grievance
<br />procedures outlined in Article V[II.
<br />Section X15. Iumereency Anttoinhnent
<br />An emergency appointment may be made when a situation exists requiring the services of au employee
<br />before it is possible to identify a qualified applicant through the regular selection process. When it is
<br />determined by the County Manager or appointing authority that an emergency appointment is necessary,
<br />all other requirements for appointment will be waived. An emergency appointment may be made for a
<br />period of up to 60si-xty work clays (consecutive ornon-consecutive). Any one individual may not receive
<br />successive emergency appointments with the same department or agency. At least three calendar months
