Article I. Organization of Personnel System <br />Section 1. Puruose <br />The purpose of this Ordinance is to establish a personnel system which will recruit, select, develop <br />and maintain an effective and responsible work force. This ordinance is established under the <br />authority of the North Carolina General Statues, Chapter 153A, Article 5 and Chapter 126. <br />Section 2. Coverage <br />All employees in the County's service shall be subject to this Ordinance, except as provided in this <br />section. <br />(a) The following officials and employees are exempt: <br />1. Elected Officials; <br />2. County Manager; <br />3. County Attorney; <br />4. Tax Administrator; <br />5. Members of advisory and special boards or commissions; <br />6. Contractual employees of the Board of County Commissioners; <br />7. Employees of the Cabarrus County public school systems; <br />8. Members and employees of other County established authorities (separate or in partnership). <br />(b) The following employees shall be covered only by the specifically designated Articles and <br />Sections: <br />1. Employees governed by the State Personnel Act shall be subject to all Articles except Article <br />II, Section 2, Article III, Section 5, and Article VII, Sections 1.(e) and 2-5. <br />2. Temporary employees desig atn ed by the Board of Commissioners shall be subject to all <br />Articles except Article III, Sections 12-13; Article 1V, Sections 12-14; Article VI, Sections 2- <br />17, 19-25 and 27; Article VII, Sections 1-5; and Article IX, Sections 1, 4, 6 and 7. <br />3. Employees of the Sheriff and Register of Deeds shall be subject to all Articles except Article <br />I, Section 4; Article IV, Sections 3-7 and 10-15; Article VII, Sections 2-6; and Article VIII, <br />Sections 1-5. <br />4. The Director of Elections and employees of the County Board of Elections shall be subject to <br />all Articles except Article I, Section 4; Article IV, Sections 3-7 and 10-15; Article VII, <br />Sections 2-6; and Article VIII, Sections 1-5 unless otherwise permitted by the current County <br />Board of Elections. <br />Section 3. Definitions <br />(a) Adverse Action. A suspension, demotion, dismissal, reduction in pay, involuntary transfer or <br />lay off. <br />(b) Anniversa Date. An employee's original date of hire for Cabarrus County service in a <br />permanently established position. This maybe adjusted to an artificial date if there is split <br />service, promotion, or other identified action. <br />(c) Appointing; Authority. Any position with the legislated or delegated authority to make hiring <br />decisions. (The Board of Elections, County Manager, Sheriff, Register of Deeds and State <br />Personnel Act department heads.) <br />Attachment number 6 <br />Page 226 of 362 <br />F-5 <br />
