AMENDMENT No. 31 TO THE AGREEMENT <br />BETWEEN <br />OWNER AND ENGINEER <br />FOR <br />PROFESSIONAL SERVICES RELATED TO THE <br />CABARRUS COUNTY SOLID WASTE PROGRAM <br />FURTHER DESCRIPTION OF BASIC SERVICES, DUTIES OF' OWNER, <br />METHOD OF PAYMENT, AND RELATED SERVICES <br />This AMENDMENT to THE AGREEMENT made as of December 28, 2007, is hereby included as <br />an addition to and incorporated as part of the AGREEMENT FOR ENGINEERING SERVICES <br />made on February 4,1991, between Cabarrus County, North Carolina (OWNER or COUNTY) <br />AND Cam~Dresser & McKee (ENGINEER or CDM) for study and report professional <br />services. <br />REGULATORY AND WETLAND ASSESSMENT FOR EXPANSION OF THE <br />CONSTRUCTION & DEMOLITION LANDFILL AT THE <br />CABARRUS COUNTY SOLID WASTE FACILITY <br />The proposed Cabarrus County Construction and Demolition (C&D) Landfill expansion is located <br />within the property boundary of the existing Cabarrus County Solid Waste Management Facility <br />located on Irish Potato Road outside of Concord, North Carolina. The proposed expansion of +/- <br />7 acres is located immediately to the east of the C&D Landfill expansion permitted in December <br />2006. The proposed expansion area is referred to as the 2nd or eastern half of the original <br />expansion area or "dog bone' shaped footprint. The eastern half of the "dog bone' footprint was <br />originally considered a part of the previous expansion plans; however, due to the presence of <br />wetlands and the urgent need for permitted airspace, the area was omitted from the expansion <br />area permitted in December 2006. <br />The purpose of this Amendment is to assess the current regulatory environment and wetland <br />mitigation requirements regarding the next lateral expansion of the existing C&D Landfill. Since <br />the previous Cabarrus County C&D landfill expansion, new Solid Waste Management Rules have <br />been adopted regarding the permitting of C&D landfills. The previous Rules (.0503, .0504, and <br />.0505) governing C&D landfill permitting were replaced in January 2007 with Rules .0531 through <br />.0547. In particular, C&D landfills permitted to operate prior to January 1, 2007 and which <br />continue to receive waste after June 30, 2008 must comply with Rule .0547 at the time of closure of <br />the units. <br />North Carolina Senate Bill 1492 entitled "The Solid Waste Management Act of 2007" was signed <br />by the Governor on August 31, 2007 and became Session Law 2007-550. This new law stipulates <br />significant new requirements governing solid waste management in North Carolina. Several of <br />the new requirements impact the permitting and construction of C&D landfill units.
