CDM visited the proposed landfill site with USACE Engineers staff in 2005 to determine whether <br />the two ponds on the site are jurisdictional (subject to regulation by USACE). During the visit, <br />USACE staff confirmed that the stream flowing south (downstream) from the lower (south) pond <br />is intermittent or perennial and is a USACE jurisdictional stream. Because the stream is <br />jurisdictional, both ponds are also considered jurisdictional. Two jurisdictional channels were <br />also observed during the site visit. One channel begins. at the lower pond and continues <br />downstream. The second channel is located to the east and is shown as a small draw/ ditch on the <br />existing topography. This channel begins at approximately the same plan location as Channel l <br />(the downstream boundary of the lower pond). In addition to the two jurisdictional streams, <br />there are pockets of jurisdictional wetlands in the area between the streams. <br />Two types of Section 404 permits are issued by USACE: General Permits and Individual Permits. <br />Based on the impacts anticipated for this project, an Individual Permit will be required. The <br />subtasks provided below describe the scope of work for providing engineering services related to <br />Section 404 and Section 401 permitting for the landfill expansion. <br />Subtask 3.1-Data Collection <br />CDM will collect USDA. soil survey data, wetland mapping from US Fish and Wildlife Service <br />National Wefland Inventory maps, and other available maps and documents to identify general <br />wetland areas and for use as background information. CDM will also collect lists of federally <br />protected species in Cabarrus County and their habitat. CDM will review the available maps and <br />data prior to visiting the site. <br />Subtask 3.2 -Site Visits and Delineation <br />CDM staff will visit the landfill expansion site and delineate wetlands on an approximately 5-acre <br />site. Wetlands will be de]ineated according to the 1987 US Army Corps of Engineers Wetland <br />Delineation Manual and new JD forms required in compliance with the Rapanos court decision <br />(2007). Wetland boundaries will be flagged in the field. Estimation of the time required to <br />delineate wetlands on a site depends heavily on site conditions. CDM has assumed that 3 field <br />days will be required. <br />After wetland boundaries have been flagged, CDM will schedule a wetland verification visit with <br />USACE staff. USACE staff will visit the site to verify the wetland delineation. One field day will. <br />be required for this visit. <br />Wetland/stream boundary flagging must be surveyed so that a jurisdictional delineation map can <br />be prepared and the wetland boundaries can be demarcated on the construction plans. CDM <br />.assumes that Cabarrus County will retain a surveyor to survey the wetland boundaries as marked <br />by wetland flagging and provide a map of the delineation. CDM will then send the delineation <br />map to USACE for signature. CDM will discuss the findings with the County up through Subtask <br />3.2 before proceeding with Subtask 3.3. <br />Subtask 3.3 - 4041401 Applications <br />CDM will prepare a 404 permit application using USACE Form 4345 and the Pre-Construction <br />Notification form for the 401.Water Quality Certification.
