c. Failure to submit a required report by the scheduled, submission date will result. in the <br />'withholding of any subsequent grant payment until the CENTER' is in repeipt of the <br />delinquent report. <br />d. All funds awazded to the GRANTEE under this Agreement are awazded at the direction <br />of the e-NC, established by the North Carolina General Assembly. Accordingly, the <br />GRANTEE acknowledges and agrees that'it will be subject to the audit and reporting <br />requirements prescribed by N.C.G.S. § 143C-6-23 et. seq., Non-Stare Entities Receiving <br />State Funds or N.C.G.S § 159-34, The Local Government and Fiscal Control Act -Annual <br />Independent. Audit, Rules, and Regulations; as applicable. Such audit and reporting <br />requirements may vary depending upon the amount and source of funding received by <br />GRANTEE, and are subject to change from time to time. In addition to the audit and <br />reporting. requirements mandated by the State of North Cazolina, the GRANTEE agrees <br />to comply with. any requests, including but not'limited to requests for copies of audits <br />prepazed under N.C.G.S. §159-34, made by the CENTER from time to Gme for other <br />financial and organizational materials to permit the CENTER to comply with its. fiscal <br />monitoring responsibilities. <br />e. The GRANTEE agrees that within thirty (30) days after the termination of this <br />Agreement, a fmal report (the Final Report) shall be submitted to the e-NC. In the Final <br />Report, the GRANTEE should describe how the Grant Funds were utilized. In addition <br />to accounting for the use of the Project funds during the current fiscal yeaz, the Final <br />Report must include a detailed final financial report by category (e.g., materials; <br />eguipnaen.t, etc.) showing all expenditures during the entire term of this Agreement, and <br />also report the sources and amounts of all other funds used to support the Project, <br />f. The e-NC may request from the GRANTEE certain information that will assist the e-NC <br />and/or the CENTER with evaluation of the short and long-range impact of its programs. <br />The GRANTEE recognizes that such requests may occur after termination of this <br />Agreement and agrees, to the extent possible, to provide such information as requested. <br />12. If the CENTER or e-NC finds that GRANTEE has used Grant Funds for au unauthorized purpose, <br />or in a manner not agreed and approved as provided in this Agreement, e-NC shall report such <br />findings to the Attorney General, The Office of State Budget and Management, the Office of the <br />State Auditor, and the Office of the State Controller. Funds shall not be disbursed to GRANTEE <br />if the GRANTEE fails to comply with the reporting requirements of this Agreement, and those of <br />9 N.C.A.C. 3M.0101 et. seq. <br />13. ~giect Records. <br />a, The GRANTEE shall maintain full, accurate and. verifiable financial records, supporting <br />documents, and all other pertinent data for this Project in such a manner so as to identify <br />and document clearly the expenditure of the CENTER funds provided under this <br />Agreement, separate from accounts for other awards, monetary contributions, or other <br />revenue sources for this Project. <br />b. The GRANTEE shall retain all financial records, supporting documents, and all other <br />pertinent records related to this Agreement fnr five f51 ygars following the Termination <br />ate. In the-event such records are audited, all Project records shall be retained beyond <br />such three-yeaz period until any and all audit findings have been resolved. <br />c. Pursuant to N.C.G.S. §143C-6-23, and §147-64,7, the GRANTEE agrees to make <br />available fo the State Auditor, the CENTER, or its designated representative, all of its <br />records which relate to the Project, and agrees to allow the CENTER or its representative <br />to audit, examine and copy any and all data, documents, proceedings, records and notes <br />of activity relating in any way to the Project. Access fo these records shall be allowed <br />upon request at any time during normal business hours and as often as the CENTER or its <br />representative may deem necessary. <br />F-g <br />Page 4 of 12 <br />
