CABARRUS COUNTY DEPARTMENT OF AGING <br />LUNCHPLUS CLUB CONTRACT FOR FOOD SERVICES - FY'2009 <br />THIS AGREEMENT entered into and becoming effective the first day of August 2008 by <br />and between Varsity BBQ, hereinafter referred to as the "Caterer", and Cabarrus <br />County Department of Aging, hereinafter referred to as the "Purchaser". <br />FOOD CONTRACT SPECIFICATIONS <br />WHEREAS, the Purchaser desires to engage the Caterer to render services in <br />connection with the LunchPlus Club Program, hereinafter referred to as the "Program", <br />provided through the Older Americans Act grant funds provided to the Purchaser <br />through the Centralina Council of Governments Area Agency on Aging from the North <br />Carolina Division of Aging and Adult Services and the United States Department of <br />Health and Human Services; and <br />WHEREAS, the Caterer is a food service management company with the demonstrated <br />capacity and desire to supply services; <br />NOW THEREFORE, in consideration of the premises and the mutual covenants and <br />agreements hereinafter contained, the parties hereto agree as follows: <br />The Caterer agrees to sell and the Purchaser agrees to buy all Purchasers' <br />requirements for this Program according to the provisions of the agreement. Caterer <br />agrees not to sub-contract for the delivery of the services called for in this agreement. <br />This Agreement will be in effect and services will be delivered beginning August 1, <br />2008, and continue through July 31, 2009. This contract may be renewed a maximum <br />of two (2) twelve-month terms upon agreement of both parties. <br />The Purchaser will order from the Caterer approximately 215-275 meals daily for <br />approximately 185 serving days, depending on the availability of funding and <br />participation levels within the Program. Caterer shall be obligated to deliver meals to <br />five (5) LunchPlus Club locations designated by the Purchaser, if funding allows these <br />five (5) sites to remain open, and any additional sites as added by the Purchaser. <br />The Caterer will deliver meals in bulk to each LunchPlus Club location Monday through <br />Friday during the period of this agreement with the exception of the holidays specified <br />herein or except as provided within the terms and conditions of this contract. <br />Independence Day ........... ..........July 4, 2008 <br />Labor Day ...................... ..........September 1, 2008 <br />Veterans Day .................. ..........November 11, 2008 <br />Thanksgiving ..................... ...........
