I' <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />AMENDMENT No. 35 <br />TO THE AGREEMENT <br />BETWEEN <br />OWNER AND ENGINEER <br />FOR <br />PROFESSIONAL SERVICES RELATED TO THE <br />CABARRUS COUNTY SOLID WASTE PROGRAM <br />FURTHER DESCRIPTION OF BASIC SERVICES, DUTIES OF C <br />METHOD OF PAYMENT, AND RELATED SERVICES <br />This AIviENDMENT to THE AGREEI/1ENT made as of 1Vovember 24, 2008 is hereby, included as an <br />addition to and incorporated as part of the AGREEMENT FOR ENGINEERING SERVICES made on <br />February 4,1991, between Cabarrus County, North Carolina (OWNER or County) and -Camp <br />Dresser & McKee (ENGINEER or CDM) for study and report professional services. <br />DESIGN AND PERMITTING FOR EXPANSION OF THE <br />CONSTRUCTION ~ DEMOLITION LANDFILL AT THE <br />CABARRUS COUNTY SOLID WASTE FACILITY <br />The purpose of this Amendment is to design the next lateral expansion of the existing Cabarrus <br />County Construction & Demolition (C&D) Landfill and prepare a Permit to Construct Application <br />in accordance with the North Carolina Solid Waste Nlanagement Rules. Since the previous <br />Cabarrus County C&D Landfill expansion, new Solid W aste Management Rules have been adopted <br />regarding the permitting of C&D landfills. North Carolina Senate Bill 1492 entitled "The Solid <br />Waste Management Act of 2007" was signed by the Governor on August 31, 2007 and became <br />Session Law 2007-550. This new law stipulates significant new requirements governing solid waste <br />management in North Carolina. Several of the new requirements impact the permitting and <br />construction of C&D landfill units. The previous Rules (.0503, .0504, and .0505) governing C&D <br />landfill permitting were replaced in January 2007 with Rules .0531 through .0547. <br />Based upon initial conversations with the North Carolina Department of Envixonment and Natural <br />Resources (NCDENR) Solid Waste Section (SWS), the County is required to submit a Substantial <br />Amendment and a Permit to Construct in order to obtain additional construction and demolition <br />(C&D) landfill airspace. The permit will delineate an overall C&D landfill footprint and identify <br />individual 5-year operating phases. The Substantial Amendment and Permit to Construct will be <br />prepared in accordance with Rules 15A NCAC 13B .0535(c): Substantial amendment to the permit <br />and .0535(a)(1): Permit to Construct. The next operating phase that the Permit to Construct will be <br />developed for will be the piggyback expansion. <br />The Substantial Amendment and Permit to Construct for the piggyback expansion will include the <br />following: site/design hydrogeologic reports, facility plan, engineering plan, geotechnical <br />evaluation, construction quality assurance plan, operation plan, revised closure and post-closure <br />plan, monitoring plans, and local government approval. In accordance to the scope and budget <br />provided below, CDM will prepare and submit to the SWS, on behalf of the County, a Substantial <br />Item# 9 <br />Attachment number 1 <br />F-5 <br />Page 85 of 185 <br />
