r <br />Task 10.2 -Zoning jurisdiction Letter, Rule .0536(c}(11}(E} <br />The County shall provide a letter as part of the substantial amendment from the unit of local <br />government having zoning jurisdiction over the site which states that the proposed facility <br />meets all the requirements of the local zoning ordinance. CDNI assumes that the County has <br />zoning jurisdiction over the property and will provide CDNI a letter that satisfies this <br />requirement. <br />TASK 11-SUBSTANTIAL AMENDMENT AND PIGGYBACK PERMIT TO CONSTRUCT <br />APPLICATION PREPARATION AND RESPONSE <br />CDM will prepare two complete permit documents for the Cabarrus County C&D Landfill <br />Substantial Amendment and Piggyback Permit to Construct and submit to the SWS, which will <br />include the report and plan sections as defined in Tasks 1 through 10. Along with the hard <br />copies, CDNI will prepare and submit electronic copies on compact disc. CDM will prepare and <br />submit three copies of the completed permit to the County for their records. As part of this task, <br />CDNI will prepare and submit responses to any review comments received by the County from <br />SWS in effort to provide the County with an approved Substantial Amendment and Permit to <br />Construct. <br /> <br />~I'' <br />li <br />0 <br />An application for a substantial amendment to a solid waste permit requires, upon submission <br />of an application, payment of an application fee. For C&D landfills accepting less than 100,000 <br />tons/year of waste, the permit fee is $15,000. CDM will submit the application fee along with <br />the submittal of the permit documents. The permit fee of $15,000 has been included in the <br />budget. <br />CDM and the County recognize that this project will be done under the State's new C&D <br />regulations and there is limited experience as to how the SWS will regulate these rules. <br />2. The responsibility of OWNER as described in Section 4 of said Agreement are amended and <br />supplemented as follows: <br />^ Review deliverables in a timely manner. <br />^ The County will employ and pay directly the County surveyor for Task 2. <br />^ The County will provide financial assurance documentation for Task 8. <br />^ The County will conduct a public meeting for Task 10.1 <br />^ The County will provide the zoning jurisdictional approval for Task 10.2. <br />3. The time period for the performance of ENGINEER's services as set forth in Section 4 of said <br />Agreement are amended as follows: <br />CDNI will complete Tasks 1-11 (excluding responding to SW5 comments} within five months <br />from the notice to proceed. <br />4.
