1. LEASED SPACE. Arts Council will lease all of the offices located in the <br />Courthouse located on the first floor except for the "Museum Room" whjich is currently <br />leased to Historic Cabarrus, Inc. Arts Council will also have shared use of a conference <br />room and the kitchen in the Courthouse. Hereafter, the office space and shared use of the <br />conference room and kitchen shall be collectively referred to as the "Leased Premises". <br />The County will install electrical and telephone connections in the Leased Premises for <br />the use of Arts Council. <br />2. TERM OF LEASE. To have and to hold for a term of 10 years <br />commencing on January 1, 2007, and ending at midnight on December 31, 2016, unless <br />sooner terminated by written mutual consent of both parties. The term of the Lease shall <br />be automatically extended for two (2) additional five year terms, unless either party gives <br />written notice at least sixty (90) days prior to the end of the then current term that it <br />wishes to terminate the Lease. <br />3. LEASE PAYMENTS. Arts Council shall pay the County annual rent of <br />$1.00(ONE DOLLAR) for the right to occupy the Leased Premises. Lease payments <br />shall be due and payable the first day of July each year of the Lease term. <br />4. COUNTY RESPONSIBILITIES. <br />a) Maintenance: The County will maintain the exterior of the Courthouse <br />building and the grounds, which responsibilities will include, without limitation, <br />maintenance and repair of the Courthouse structure, roof, HVAC system, <br />landscaping and lighting of the Courthouse grounds, and maintaining the <br />currently available parking facilities on the Courthouse grounds. All maintenance <br />and repairs shall be performed in a workmanlike manner, normal wear and tear <br />excepted. In addition, the County agrees to maintain the interior of the <br />Courthouse building in a condition as much like its original condition as possible; <br />provided however, that central heating, air conditioning, electrical fixtures and <br />appliances may be utilized in such ways that are as non intrusive as possible on <br />the Courthouse interior and in keeping with the original fixtures. The County <br />may make such additional improvements as shall contribute to the beauty of the <br />Courthouse as close as possible to what is believed to be its original existence. <br />All such improvements shall be done under consultation with a competent <br />architect and according to a general plan of organized historic renovation and <br />restoration. <br />~~ <br />
