I <br />checked the statutes and spoke with Shea Denning at the School of Government to make sure we were <br />following the proper course in our handling of the situation. As you know real property in Gakrarrus County is <br />permanently listed and as such we must tax according to the owner of record. Although it is clear what the <br />intent was the legal records tell a different story. Therefore, neither of these properties qualified for exemption in <br />2005 or 2006. Even though it remained in the name of Union Lodge the old lodge was not in use and therefore <br />would not qualify for exempt status. The new lodge would not qualify because it was in the name of <br />non-qualifying owner. I don't. think, and Shea agreed, that there is anything we can do but carry both of these <br />properties as taxable in the names of the oevner's of record for both years. A request for a release or refund of <br />either of these bills would be governed by 105-381 and I do not believe such a request would qualify under this <br />statute. <br />Sorry that I could not be of more help. On January 5, 2005 1 was involved in a <br />transaction with the Union Lodge and Barrett Flowe. Unfortunately the wrong legal description was used in the <br />transaction and the Lodge's current property was transferred my mistake. We are in the process of rectifying <br />this and should have the deeds recorded to have the Lodge and Mr. Flowe swap the properties so that Mr. <br />FLowe will have the correct land and the Lodge will have its property back in it's name. The problem is this: <br />The Lodge had an exempt status for 2005 on the property that was accidentallytransferredaod now a bill has <br />been sent recently to collect 2005 taxes and I assume one will be issued for 2006. Since the Lodge has <br />continued to occupy the property for a tax exempt purpose and the transfer was accidental, is there any way the <br />discovered bill and the 2006 bill be waived so that the tax situation should be as it would have been except for <br />the mistake?
