AMENDMENT No. 28 TO THE AGREEMENT <br />BETWEEN <br />OWNER AND ENGINEER <br />FOR <br />PROFESSIONAL SERVICES RELATED TO THE <br />CABARRUS COUNTY SOLID WASTE PROGRAM <br />FURTHER DESCRIPTION OF BASIC SERVICES, DUTIES OF OWNER, <br />METHOD OF PAYMENT, AND RELATED SERVICES <br />This AMENDMENT to THE AGREEMENT made as of Februarv 14, 2007 is hereby included as <br />an addition to and incorporated as part of the AGREEMENT FOR ENGINEERING SERVICES <br />made on Februarv 4,1991, between Cabarrus Count North Carolina (OWNER or COUNTY) <br />AND Cam Dresser & McKee (ENGINEER or CDM) for professional services. <br />CABARRUS COUNTY SOLID WASTE MANAGEMENT <br />DESIGNIBIDDING SERVICES FOR CLOSURE OF THE <br />EXISTING C&D LANDFILL <br />The purpose of this amendment is to provide Cabarrus County Solid Waste Management with <br />design/bidding services for closure of the existing C&D Landfill located at 4441 Irish Potato Road <br />(SR 2411), Concord, North Carolina. Transition Plans approved by the NCDENR Solid Waste <br />Section in January 1998 and March 1999 permitted C&D waste to be disposed of on top of the <br />closed Unit 3 MSW Landfill, representing a combined Phase 1 and Phase 2 C&D waste disposal <br />area of approximately 14 acres. (Note: The exact number of acres to be closed, in addition to the <br />actual limits of waste are to be determined by CESI survey under contract with Cabarrus County <br />prior to design). Closure of the partially filled Unit 3 MSW Landfill was first completed in March <br />1999, in accordance with 15A NCAC 13B Section .1627 of the North Carolina Solid Waste <br />Management Rules, requiring a soil cap meeting a maximum permeability of 1 x 10'5. The average <br />permeability achieved during closure was, however, 5 x 10-' as presented in the CQA Document <br />prepared by CDM and submitted to the SWS on March 5,1999. North Carolina Solid Waste <br />Regulations Section .1627(c)(1)(A) states that the closure cap for the C&D waste piggy-backed on <br />top of the lower Unit 3 MSW Landfill must achieve a permeability less than or equal to the <br />permeability of that achieved for the lower MSW closure cap. This will then require the closure <br />cap for the C&D Landfill to be the equivalent or less than the 5 x 10'' average permeability <br />achieved for the lower MSW landfill closure. This can be accomplished by constructing an 18-inch <br />thick compacted clay soil cover meeting a maximum permeability of 5 x 10-' or a composite <br />.liner/drainage system with 18-inches of cover soil with no specified permeability requirement. In <br />either case, a 6-inch vegetative cover layer would be required over the 18-inch soil cover layer. <br />CDM will consider alternate closure designs with regard to cost and material availability. In <br />addition to closure design and bidding services, this amendment will also address design of a <br />landfill gas collection and passive venting system to be incorporated into the closure cap. <br />It is understood that CESI will provide the survey for design of the C&D Landfill closure, to <br />Page 1 of 7 <br />~- <br />
