As you may recall, this particular rezoning <br />request was for property that was zoned OI, Office Institutional (in the mass rezoning of 2005) to be <br />rezoned to CR, Countryside Residential. <br />• At the January 22nd meeting of the Board of Commissioners, the Board requested that the item be <br />returned to the Planning and Zoning Commission for discussion and a recommendation. <br />• The current policy regarding refunds is that each request is handled on a case by case basis and the <br />refund request is made to the Board of Commissioners, not the Planning and Zoning Commission. <br />• The Board of Commissioners would like for the Planning and Zoning Commission to make a <br />recommendation regarding the current request and to make a policy recommendation on how refunds <br />for planning and zoning items should be addressed in the future. <br />Possible Options for Planning and Zoning Commission Consideration: <br />Maintain the current policy. <br />• Requests to be handled on a case by case basis with the Board of Commissioners being the Board <br />that entertains the request. <br />Amend the current policy. <br />Requests to be handled on a case by case basis with the Planning and Zoning Commission making a <br />recommendation to the Board of Commissioners with the Board of Commissioners making the final <br />decision on the request. <br />• Requests to be handled on a case by case basis with the Planning and Zoning Commission being the <br />Board that entertains the request. <br />• Create a policy that no refund requests will be issued regarding Planning and Zoning cases that have <br />already been decided, or that have already been processed by staff, because the cases have been <br />reviewed and noticed as required by the State Statutes and there are costs associated with <br />processing and noticing the case. <br />r'~ <br />
