Memo <br />To: Cabarrus County Planning and Zoning Commission <br />From: Susie Zakraisek, AICP, Planning and Zoning Manager <br />CC: File <br />Date: 2/28/2007 <br />Re: Proposed Policy for Noticing Cases <br />• Mr. Archie Smith has requested that a refund be issued for the rezoning case that the Planning and <br />Zoning Commission considered on November 16"'of 2006. As you may recall, this particular rezoning <br />request was for property that was zoned OI, Office Institutional (in the mass rezoning of 2005) to be <br />rezoned to CR, Countryside Residential. <br />• At that meeting, Mr. Smith and his family members contended that they were not notified that the <br />rezoning to OI was being considered or that it had already occurred. <br />Mr. Smith sent a letter to the Board of Commissioners questioning the County noticing practices for <br />mass rezonings. As a result of that letter, the Board discussed noticing requirements and is asking <br />the Planning and Zoning Commission to look at policy options regarding notice of zoning <br />amendments. <br />• The Board of Commissioners would like for the Planning and Zoning Commission to make a <br />recommendation regarding noticing of rezoning cases that involve more than 50 parcels. <br />Options for Planning and Zoning Commission Consideration: <br />Maintain the current policy. <br />• Rezoning requests of more than 50 parcels are noticed in accordance with the established state <br />statutes. <br />Amend the current policy. <br />• Rezoning requests of more than 50 parcels are noticed in accordance with the established state <br />statutes.
