Section 15-7 Determination ofAdequacy For Reservation <br />of Capacity <br />When the development application and reservation of capacity applications are <br />reviewed by the appropriate Reviewing Agency, the Reviewing Agency shall <br />provide that information to the Cabarrus County Manager or his/her designee. <br />Once the review agent has provided the appropriate information, one of the <br />following recommendations shall be made by the Cabarrus County Manager or <br />his/her designee: <br />1. A~nroval of the Reservation <br />If the review concludes that public facilities are presently available at the <br />Adopted Level of Service, the application for development shall be approved <br />without any of the conditions required by this Chapter. (In this case, no Consent <br />Agreement shall be required.) <br />2. Denial of the Reservation <br />If the review determines that any Public Facility will not be available at the <br />Adopted Level of Service based upon Available Capacity, the application must be <br />denied. However, as an alternative, the Reviewing Agency may approve the <br />reservation of capacity application with conditions as provided in subsection 3, <br />below. <br />3. Conditions Qf the Reservation <br />The Reviewing Agency may require, or the Applicant may consent to, conditions <br />that reduce or mitigate the impacts of the proposed development. Conditions <br />may include any or a combination of the following: <br />a) deferral of final plats, building permits or certil:tcates of occupany <br />until all Public Facilities are available and adequate if Public <br />Facilities in the Impact Area are not adequate to meet the Adopted <br />Level of Service for the entire development proposal, consistent <br />with the requirements of this Chapter; <br />b) phasing of final plats, building permits, or certificates of occupancy <br />so thaty?, future increments of development are not constructed until <br />future capacity becomes available; <br />c) reduction of the density or intensity of the proposed development <br />to a level consistent with the Available Capacity of Public Facilities; <br />d) provision by the Applicant of the Public Facilities necessary to <br />provid@ Capacity to accommodate the proposed development at the <br />DRAFT TEXT OPTION 2 <br />8/20/2007 - 12 - <br />C:\Documents and Settings\gkhoneycutt\Local Settings\Temporary Internet <br />Files\OLK7\APFO_draftf4rBOCoption2_08_20_07 meeting.doc <br />G -~ <br />
