4. Duration of Reservation <br />Once the applicant has submitted an application for development review and an <br />application for reservation of capacity and the applications are reviewed, if a <br />reservation of capacity is approved, the approval shall be good for a period not <br />to exceed 2 years from the date of the Development Order approval by the <br />appropriate jurisdiction. <br />5. Extensions for Reservation of Capacity <br />No extensions shall be granted for a reservation of capacity that has been issued <br />as part of a Consent Agreement. In the event a Consent Agreement expires, <br />the applicant will be required to start the development review process from the <br />beginning and shall be subject to any ordinances and policies in place at that <br />time. <br />6. Consent Agreements. <br />Applicant shall enter into a Consent Agreement once a Development Order has <br />been granted from the appropriate jurisdiction. Said Consent Agreement shall <br />identify and incorporate the terms of the reservation of capacity review. <br />a) The Consent Agreement is a regulatory document containing <br />specific conditions of development approval as defined in the <br />Reservation of Capacity Certificate and designed to implement the <br />policies and criteria contained in this Chapter and, where the denial <br />or deferral of development approval is disputed by the applicant, to <br />effectuate the public policy favoring the settlement of disputes. <br />b) The Consent Agreement must contain an integrated development <br />scheme for a particular phase or phases of development approval, <br />along with maps, diagrams and other appropriate materials <br />showing future conditions consistent with the provisions of this <br />Chapter. <br />d) The Consent Agreement must be approved by the Cabarrus County <br />Board of Commissioners. The Consent Agreement will be reviewed <br />by the Cabarrus County Manager or his/her designee and placed on <br />the Consent Agenda at a normal meeting of the Board of County <br />Commissioners, unless a special meeting is convened for this <br />purpose.
