PLANNING STAFF REPORT
TO CABARRUS COUNTY BOARD OF COMMISSIONERS
Monday, February 20th, 2006

Petition: C2006-01 (ZT)

n:'. \ f.'D< '.-'"

; \:ni-:d

i-clbkd

Purpose: This text amendment is in response to a citizen's request to build an attached garage onto
his home in the Cessna Springs subdivision. The property was rezoned in the June 2005 mass rezoning
from Cabarrus County MDR-Medium Density Residential to Cabarrus County CR-Countryside
Residential. Under the previous zoning, the sideyard setbacks were 5 (single) and 20 (total), i.e. the
principal structure could sit as close as 5 feet to the property line, but the combined total of the sideyard
setbacks required was 20 feet. The petitioner sought a building permit to start construction on the attached
garage, only to learn that the setbacks would not permit the addition. The petitioner is requesting to
amend the sideyard setbacks in the CR-Countryside Residential district from 20 (single) and 40 (total) to
10 (single) and 40 (total). Approval of this amendment will effect the following change:

1. Chapter 5 District Development Standards of the Cabarrus County Zoning Ordinance would be
amended to read as follows: (changes are indicated in RED)

Lot Dimensions (minimum)
Lot area (acres)
Average lot width (feet)
Principal (minimum feet)
Front yard (minor collector)
Front yard (local road)
Side yard (single)
Side yard (total)
Rear yard
Height (maximum feet)
Lot Coverage (maximum)
Impermeable surface 15% 20% 20%
Structural coverage __ !Q_~ J.~% 15%
.* Governmental water may be provided to individual lots in these areas for public health reasons.

CONVENTIONAL SUBDIVISION

Tract
Density (maximum units/acre)
Public water and sewer

AO CR LDR

Single-Family Single-Family Single-Family
Detached Detached Detached

~,c ~.,. ~..
.- -.. It will also allow for more
flexibility in structural placement in the CR district while still retaining the total sideyard
setback requirement of 40 feet. On January 19th, 2006 the Cabarrus County Planning and
Zoning Board voted unanimously to recommend approval of this text amendment to the
Board of Commissioners.

Staff Recommendation: Planning Staff recommends APPROVAL of petition C2006-0 1 (ZT).

Pag~ 1 of I
Pd-ition C2006-0 1 (7T)

G--~
