<br />STATE OF NORTH CAROLINA ) <br />) <br />COUNTY OF CABARRUS ) <br /> <br />LEASE <br /> <br />THIS LEASE made and entered into as of this _ day of , 2006, by and <br />between KANNAPOLIS LAND, INC., having its principal office in Greenville County, South <br />Carolina at Post Office Box 1177, Greenville, South Carolina 29602, (herein referred to as <br />"Landlord"), and CABARRUS COUNTY, a governmental entity having an address at Cabarrus <br />County Government Center, Post Office Box 707, Concord, North Carolina 28025 (herein <br />referred to as "Tenant"). <br /> <br />WITNESSETH: That in consideration of the rents, covenants and conditions herein <br />set forth, Landlord and Tenant do hereby covenant, promise, and agree as follows: <br /> <br />1. Demised Premises: Landlord is the owner of a tract of land situate in the <br />County of Cabarrus, North Carolina, and more particularly described in Exhibit "A" hereof. <br />Landlord has developed said property as a Shopping Center. <br />Landlord does demise unto Tenant and Tenant does take from Landlord for the lease term <br />of the store premises, situate in said Shopping Center. The space will be Unit 2 outlined in red <br />on the site plan attached hereto as Exhibit "B": said premises having approximately 2800 square <br />feet measured from the outer edge of all outside walls and the centerline of all interior walls. <br />Landlord further grants to Tenant the non-exclusive right to use the common areas of the <br />Shopping Center (including but not limited to parking areas, walkways, driveways, pickup and <br />delivery areas). Said premises together with all rights, privileges and easements, appurtenant <br />thereto shall be herein collectively referred to as the "demised premises". <br />2. Use: Tenant shall use and occupy the leased premises for county offices and <br />customary government functions only, and for no other purpose. Tenant agrees to be strictly <br />bound by this use restriction, as same is a material consideration of Landlord in making this <br />lease. <br /> <br />3. Term: The term of this lease shall be for five (5) years, commencing March 24, <br />2006, and terminating on March 23, 2011, unless sooner terminated as herein provided. <br /> <br />F-I ~ <br />
