Connectivity, architectural and site design, and access <br />management are key co.mpo.nents of these propo.sals. <br /> <br />Co.nclusio.n: There is no. utility service available to. the subject property at this time, <br />no.r is there a scheduled availability date. The propo.sed zo.ning would <br />no.t impact the scho.o.l district directly. <br /> <br />Staff Reco.mmendation: The proposed rezoning do.es not co.nfo.rm to. the propo.sed future land <br />use plan for this area. In additio.n, per the newly ado.pted zo.ning map <br />(2005) the subject property is zo.ned 0/1 and is reserved fo.r <br />o.ffice/institutio.nal uses. This actio.n by the Co.unty Co.mmissioners <br />shows support fo.r the updated, tho.ugh not fo.rmally ado.pted, new <br />No.rthwestem Area Plan. Therefore, more emphasis should be placed <br />o.n the draft area plan more so. than the o.ld (adopted) plan. <br /> <br />The request is for approximately 75.901 acres to. be rezoned to. GC <br />(General Co.mmercial). This is a co.nventio.nal rezo.ning request, <br />therefo.re all uses in the GC (General Co.mmercial) zo.ne sho.uld be <br />co.nsidered by the Co.mmissio.n and co.nditio.ns may no.t be placed o.n <br />the rezo.ning. <br /> <br />Per the intent statements in the Zo.ning Ordinance, the General <br />Co.mmercial zo.ne may border the o.ther less intense co.mmercial zones o.r <br />either ofthe two. industrial zo.nes. A general co.mmercial zo.ne may <br />bo.rder a higher density residential zo.ne but care sho.uld be taken to. <br />assure a buffer between the two.. This district is intended to. provide the <br />principallo.catio.n for large scale co.mmercial develo.pment. AlO <br />(Agriculture/Open Space) Zo.ning surro.unds the subject property. This <br />district is the lowest density Zo.ning district in Cabarrus Co.unty. It <br />provides areas for large single family lots, farms, and open space <br />preservation. Without additio.nal co.nditions (which are no.t permitted in <br />a co.nventio.nal rezo.ning), this petition canno.t meet the intent o.f the <br />ordinance. <br /> <br />As a result o.f the info.rmation provided above, staff cannot recommend <br />a statement o.f reaso.nableness and co.nsistency as required by No.rth <br />Caro.lina law. Therefore, staff canno.t o.ffer support fo.r the approval of <br />this petition. The Commissio.n sho.uld co.nsider all the info.rmation <br />presented and render a decisio.n accordingly. <br /> <br />~-5 <br />
