<br />INTERLOCAL DETENTION CENTER AGREEMENT <br /> <br />THIS INTERLOCAL DETENTION CENTER AGREEMENT ("Agreement") is <br />entered into effective January 9,2006, by and between Alamance Connty, North <br />Carolina, a political subdivision of the state of North Carolina, with its principal place of <br />business at 109South Maple Street, Graham, North Carolina ("Alamance County") and <br />Cabarrus County, North Carolina, a political subdivision of the state of North <br />Carolina, with its principal place of business at 65 Church Street South, PO Box 707, . <br />Concord, North Carolina 28025 ("Cabarrus County"). <br /> <br />Whereas, Cabarrus County is experiencing significant overcrowding of its inmate <br />detention mcilities; and <br /> <br />Whereas, Alamance County is not currently experiencing overcrowding of its inmate <br />detention facilities and has space available to house additional inmates; and <br /> <br />Whereas, Cabarrus County has requested that Alamance County consider hOusing 40 <br />Cabarrus County inmates and Alamance County has agreed to do so, all in accordance <br />with the terms and conditions of this Agreement; and . <br /> <br />Whereas, this Agreement is authorized pursuant to North Carolina General Statute <br />Chapter 160A-460 et.seq., <br /> <br />Now Therefore, in consideration of the premises and other good and valuable <br />consideration, the parties hereto agree as follows: <br /> <br />1. Housing Facilities. Alamance County will provide inmate detention facilities for <br />certain Cabarrus County house detainees and prisoners (hereafter, "Inmate(s )") in <br />Alamance County's Detention Centerlocated at 109 South Maple Street, Graham, <br />NC (the "Center"). Alamance County will provide the same standard of care with <br />regard to surveillance, security and protection ofInmates as is afforded Alamance <br />County detainees and prisoners. <br /> <br />2. Overcrowding of Center. In the event the Center reaches maximum capacity, <br />Alamance County shall not be required to accept any Inmates until such time as <br />the Center has enough available space to accept additional Inmates. In the event <br />the Center reaches maximum capacity after acceptance of Inmates, Alamance <br />County can require Cabarrus County to pick up Inmates housed in the Center. <br /> <br />3. Expenses. As reimbursement of general room and board expenses, Cabarrus <br />County agrees to pay Alamance County the sum offifty dollars ($50.00) per day <br />per Cabarrus County inmate housed in the Center. In addition to room and board <br />expenses, Cabarrus County will be responsible for the cost of ordinary and <br />extraordinary medical costs and expenses attributable to any Cabarrus County <br />Inmate, as set forth in the AIamance-Cabarrns County Jail Medical Exhibit <br /> <br />F-21 <br />
