<br />STATE OF NORTH CAROLINA <br /> <br />COUNTY OF CABARRUS <br /> <br />ANIMAL SHELTER <br />LEASE AGREEMENT <br /> <br />THIS ANIMAL SHELTER LEASE AGREEMENT is made and entered into as <br />of the_ day of ,2006, by and between CABARRUS COUNTY, <br />a body politic and political subdivision of the State of North Carolina (referred to as <br />"Lessor") and the CABARRUS COUNTY HUMANE SOCIETY a North Carolina <br />corporation (referred to as "Lessee"): <br /> <br />WITNESSETH: <br /> <br />In consideration of the rents agreed to be paid and in consideration of the mutual <br />covenants and agreements recited, Lessor does lease and demise unto Lessee and Lessee <br />does lease and take as tenant from Lessor those certain premises (referred to as <br />"Premises") being a portion of a building (referred to as "Building") and land having an <br />address of 244 Betsy Carpenter Drive, Concord, in the County of Cabarrus, North <br />Carolina (referred to as "Land"). Lessor shall have no obligation to make any <br />improvements in the Premises whatsoever and Lessee hereby agrees to accept the same in <br />its present condition, "as is", provided Lessor shall perform normal janitorial cleaning <br />services prior to delivering same to Lessee. <br /> <br />TO HAVE AND TO HOLD the said Premises unto the Lessee upon the following <br />terms and conditions: <br /> <br />1. TERM. The term of this Lease shall begin on the 1 st day of November, <br />2006, and shall end at 12:00 midnight on the 31th day of October, 2007. <br /> <br />2. RENT. Lessee shall pay to Lessor the sum of One Dollar ($1.00) per <br />annum, payable on or before November 30, 2007. Lessor will pay all utilities, ad <br />valorem taxes, and structural maintenance repairs required by Lessor, except as otherwise <br />provided below. <br /> <br />3. DELIVERY OF POSSESSION. Lessee has already taken possession of the <br />Premises and by having taken possession waives any objection to the condition of the <br />Premises. <br /> <br />4. DEFAULT. The occurrence of one or more of the following events <br />(herein referred to as "Events of Default") shall constitute default by the Lessee: <br /> <br />(A) Failure to pay rent or any other sum due Lessor when such amount is due; or <br /> <br />(B) Failure to perform any other provision of this Lease if the failure to perform <br />is not cured within ten (10) days after written notice thereof has been given to Lessee. <br /> <br />5. LESSOR'S REMEDIES UPON DEFAULT BY LESSEE. Lessor shall <br />have the following remedies if Lessee commits a default. These remedies are not <br />exclusive; they are cumulative in addition to any remedies now or later allowed by law. <br /> <br />G--5 <br />
