<br />(A) Lessor shall have the right to continue this Lease in full force and effect, and <br />the right to enter the Premises and relet them. Lessee shall be liable immediately to <br />Lessor for all costs Lessor shall incur in reletting the Premises and Lessee shall pay to <br />Lessor the rent due under this Lease on the date that the rent is due, less the rent Lessor <br />receives from any reletting. <br /> <br />(B) Lessor shall have the right to terminate this Lease without notice to vacate <br />(any right to which is waived by Lessee) and Lessee's rights to possession of the <br />Premises at any time, and re-enter the Premises and Lessor shall have the right to pursue <br />its remedies at law or in equity to recover of Lessee all amounts of rent then due or <br />thereafter accruing and such other damages as are caused by Lessee's default. <br /> <br />(C) No course of dealing between Lessor and Lessee or any delay on the part of <br />Lessor in exercising any rights it may have under this Lease shall operate as a waiver of <br />any of the rights of L~ssor hereunder nor shall any waiver of a prior default oJferate as a <br />waiver of any subsequent default or defaults and no express waiver shall affect any <br />condition, covenant, rule or regulation other than the one specified in such waiver and <br />that one only for the time and in the manner specifically stated. <br /> <br />6. RENEWAl", END OF TERM AND HOLDING OVER. Upon the expiration <br />of the term or other termination ofthis Lease, Lessee shall quit and surrender to Lessor <br />the Premises, broom clean, in good order and condition, ordinary wear and tear excepted <br />and Lessee shall remove from the Premises all of its property. If Lessee is not in default <br />under the terms of this Lease, Lessee may renew this Lease on the same terms and <br />conditions prior to the end of each existing one year term unless Lessor has given Lessee <br />written notice that it does not intend to permit renewal of the Lease, which notice shall be <br />given to Lessee no less than six (6) months prior to the expiration of the existing Lease <br />term. If Lessee shall hold over after the expiration of the term or other termination of this <br />Lease; such holding over shall not be deemed to be renewal ofthis Lease but shall be <br />deemed to create a tenancy-at-will and by such holding over, Lessee shall be deemed to <br />have agreed to be bound by all of the terms and conditions of this Lease except those as <br />to the term. <br /> <br />7. USE OF PREMISES. The Premises shall be used and occupied by Lessee <br />as an animal shelter, including all lawful uses incident to .such use. Lessee shall not use <br />the Premises or any portion thereof for any illegal or unlawful purpose and will not cause <br />or permit a nuisance to be created or maintained therein. <br /> <br />8. ASSIGNMENT AND SUBLETTING. Lessee shall not assign this Lease or <br />sublet the Premises or any part thereof without the prior written consent of Lessor. <br />Consent by Lessor to one assignment or subletting shall not operate as a waiver as to <br />future assignments or subleases. If this Lease shall be assigned or the Premises or any <br />portion thereof sublet by Lessee at a rental that exceeds all rentals to be paid to Lessor <br />hereunder, attributable to the Premises or portion thereof so assigned or sublet, then and <br />in such event, any such excess shall be paid over to Lessor. Lessor shall, at its election <br />upon notiCe to Lessee and without limitation, have the right to enter into a direct lease <br />with the proposed assignee or subtenant and/or terminate this Lease. <br /> <br />2 <br />G~S <br />
