<br />Current Agreement and Proposed Revisions <br />Between <br />Cabarrus Boys and Girls Club and <br />Cabarrus County - For Camp T.N. Spencer Park <br /> <br />Under Article III. Property Operations <br /> <br />3.1 Current A~reement - Property Operations <br /> <br />For the seven week period of the Club's summer day camp, it is entitled to <br />exclusive use of the pool from 800 AM to 330 PM, Monday through Friday and <br />of the existing bUIldings from 7: 30 AM to 400 PM, Monday through Friday The <br />Club shall be solely responsible for the supervision of those facilities and <br />activities therein during its summer day camp. <br /> <br />Proposed Revisions in the A~reement <br /> <br />2.1 Under Article II - Property Development <br />Eliminate this section in Current Agreement <br />The County shall maintain the existing pool facility, but shall not be obligated to <br />replace the pool facility in the event the useful, reasonable life of the pool facility <br />expires. The County agrees to maintain the existing pool facility and make <br />reasonable and necessary repairs to the existing pool facility, up to an aggregate <br />cost of $75,00000 over the term of the Lease and any extensions thereof and no <br />more than $25,00000 in anyone lease year. If repairs are needed that would <br />exceed these amounts, the County may, at its discretion, cease to operate the <br />pool Any costs exceeding an aggregate of $75,000.00 for repairs and <br />maintenance to the existing pool facility, or replacement of the existing pool <br />facility, shall be the sole and exclusive responsibility of the Club If such an <br />event occurred, the Club may raise the money necessary to complete the <br />needed repairs or construct a new pool, in which case the County would continue <br />to operate and maintain the pool. <br /> <br />3.1 Under Article III - Property Operations <br />Revised Proposal in Section 3.1 <br />For the seven-week period of the Club's summer day camp, it is entitled first <br />priority use of the swimming pool from 800 AM to 3:30 PM, Monday through <br />Friday and of the existing buildings from 730 AM to 400 PM, Monday through <br />Friday General public park users may utilize the swimming pool facilities during <br />this seven-week day period with the Club campers; however, the Club will have <br />first priority free of charge use of the swimming pool facilities during their summer <br />day camp program To allow for general public use during the Club's summer <br />day camp program, the Club shall divide their campers into swimming groups; <br />thus allowing available room in the pool for public use. Cabarrus County shall <br />be solely responsible for the supervision, maintenance, lifeguards, and repairs/ <br />renovation to the swimming pool facilities. The Cabarrus County Boys and Girls <br />Club shall be solely responsible for the supervision of their activities (outside of <br />the swimming pool facilities) within the park during its summer day camp <br />program. <br /> <br />t--I <br />
